{"id":11718,"date":"2025-06-07T08:50:14","date_gmt":"2025-06-07T08:50:14","guid":{"rendered":"https:\/\/www.mth-partner.de\/?p=11718"},"modified":"2025-12-11T18:37:41","modified_gmt":"2025-12-11T18:37:41","slug":"auslaenderrecht-visumerfordernis-trotz-verlaengertem-schengen-visum-bestaetigt","status":"publish","type":"post","link":"https:\/\/www.mth-partner.de\/en\/foreigners-law-visa-requirement-confirmed-despite-extended-schengen-visa\/","title":{"rendered":"Aliens law: Visa requirement confirmed despite extended Schengen visa"},"content":{"rendered":"<p data-start=\"399\" data-end=\"571\"><strong data-start=\"399\" data-end=\"446\">Higher Administrative Court of Berlin-Brandenburg, Ref.: 3 S 139\/24, decision of 28 May 2025<\/strong><\/p>\n<h3 data-start=\"399\" data-end=\"571\"><span class=\"ez-toc-section\" id=\"1_Rechtlicher_Kontext_und_Problemstellung\"><\/span><strong data-start=\"577\" data-end=\"623\">1 Legal context and problem definition<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"625\" data-end=\"1033\">The decision of the Higher Administrative Court (OVG) of Berlin-Brandenburg from 28 May 2025 deals with a fundamental question of residence law: Can a foreign national who is married to a <strong data-start=\"822\" data-end=\"853\">extended <a href=\"https:\/\/www.mth-partner.de\/en\/immigration-law-no-spousal-reunion-due-to-false-information-in-schengen-visa\/\">Schengen visa<\/a><\/strong> is staying in Germany pursuant to Section 6 (2) sentence 2 AufenthG, <strong data-start=\"912\" data-end=\"931\">in the federal territory<\/strong> one <strong data-start=\"938\" data-end=\"958\">Residence permit<\/strong> although he does not have a <strong data-start=\"997\" data-end=\"1017\">national visa<\/strong> has entered the country?<\/p>\n<p data-start=\"1035\" data-end=\"1387\">The decision clarifies the distinction between a <strong data-start=\"1088\" data-end=\"1125\">extended short-stay visa<\/strong> (category C) and one <strong data-start=\"1150\" data-end=\"1199\">National visa for long-term stays<\/strong> (Category D) within the meaning of Section 6 (3) of the Residence Act (AufenthG). The key question here is whether the requirements for <strong data-start=\"1326\" data-end=\"1376\">Visa exemption according to \u00a7 39 sentence 1 no. 1 AufenthV<\/strong> are available.<\/p>\n<h3 data-start=\"1389\" data-end=\"1411\"><span class=\"ez-toc-section\" id=\"2_Sachverhalt\"><\/span><strong data-start=\"1393\" data-end=\"1411\">2. facts of the case<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"1413\" data-end=\"1790\">The applicant, an Ethiopian national, travelled to Germany in November 2023 with a <strong data-start=\"1502\" data-end=\"1540\">Schengen visa for business purposes<\/strong> to the Federal Republic of Germany. This visa was issued by the competent immigration authority in accordance with Section 6 (2) sentence 2 of the Residence Act (AufenthG). <strong data-start=\"1674\" data-end=\"1686\">180 days<\/strong> extended. Before the visa expired, the applicant applied for various residence permits:<\/p>\n<ul data-start=\"1791\" data-end=\"1983\">\n<li data-start=\"1791\" data-end=\"1844\">\n<p data-start=\"1793\" data-end=\"1844\">to participate in a language course (\u00a7 16f AufenthG),<\/p>\n<\/li>\n<li data-start=\"1845\" data-end=\"1900\">\n<p data-start=\"1847\" data-end=\"1900\">to take up vocational training (\u00a7 16a AufenthG),<\/p>\n<\/li>\n<li data-start=\"1901\" data-end=\"1983\">\n<p data-start=\"1903\" data-end=\"1983\">for employment as a film maker (\u00a7 19c AufenthG in conjunction with \u00a7 25 No. 1 BeschV).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1985\" data-end=\"2187\">The authorities rejected all applications and ordered a return together with <strong data-start=\"2059\" data-end=\"2090\">two-year entry ban<\/strong> to. The application for interim legal protection before the Berlin Administrative Court was unsuccessful.<\/p>\n<h3 data-start=\"2189\" data-end=\"2236\"><span class=\"ez-toc-section\" id=\"3_Beschluss_des_OVG_Berlin-Brandenburg\"><\/span><strong data-start=\"2193\" data-end=\"2236\">3rd decision of the OVG Berlin-Brandenburg<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"2238\" data-end=\"2575\">In its decision, the OVG rejects the appeal. It confirms the opinion of the lower court that the applicant <strong data-start=\"2365\" data-end=\"2440\">has not entered the country with the legally required national visa<\/strong> and therefore cannot apply for a residence permit in Germany (Section 5 (2) sentence 1 no. 1 AufenthG in conjunction with Section 39 sentence 1 no. 1 AufenthV).<\/p>\n<h4 data-start=\"2577\" data-end=\"2655\"><span class=\"ez-toc-section\" id=\"a_Kein_nationaler_Aufenthaltstitel_durch_verlangertes_Schengen-Visum\"><\/span><strong data-start=\"2582\" data-end=\"2655\">a. No national residence permit due to extended Schengen visa<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p data-start=\"2657\" data-end=\"3151\">A Schengen visa extended in accordance with Section 6 (2) sentence 2 AufenthG fulfils the following conditions <strong data-start=\"2729\" data-end=\"2738\">not<\/strong> the requirements of a <strong data-start=\"2765\" data-end=\"2786\">national visa<\/strong> within the meaning of Section 6 (3) AufenthG. The exemption provision of Section 39 sentence 1 no. 1 AufenthV only applies if the residence title <strong data-start=\"2915\" data-end=\"2931\">before entry<\/strong> abroad for a permanent or long-term stay <strong data-start=\"2995\" data-end=\"3006\">issued<\/strong> was issued. An extended Schengen visa - even with a maximum validity of 180 days - remains a short-stay visa in character.<\/p>\n<h4 data-start=\"3153\" data-end=\"3214\"><span class=\"ez-toc-section\" id=\"b_Entstehungsgeschichte_und_systematische_Auslegung\"><\/span><strong data-start=\"3158\" data-end=\"3214\">b. History of origin and systematic interpretation<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p data-start=\"3216\" data-end=\"3653\">The legislative history of Section 39 AufenthV also shows that the standard only covers classic national visas within the meaning of Section 6 (3) AufenthG. A <strong data-start=\"3369\" data-end=\"3396\">Legal extension<\/strong> on extended Schengen visas has never taken place, although Section 6 (2) sentence 2 of the Residence Act later expressly refers to such an extension as a \"national visa\". However, this designation has <strong data-start=\"3587\" data-end=\"3617\">No constitutive effect<\/strong> within the meaning of the Residence Ordinance.<\/p>\n<h4 data-start=\"3655\" data-end=\"3713\"><span class=\"ez-toc-section\" id=\"c_Keine_Anwendung_von_%C2%A7%E2%80%AF39_Satz%E2%80%AF1_Nr%E2%80%AF3_AufenthV\"><\/span><strong data-start=\"3660\" data-end=\"3713\">c. No application of Section 39 sentence 1 no. 3 AufenthV<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p data-start=\"3715\" data-end=\"4175\">A possible exception under Section 39 sentence 1 no. 3 of the Residence Ordinance did not apply here either. This regulation requires that <strong data-start=\"3839\" data-end=\"3888\">a strict legal entitlement after entry<\/strong> for the issue of a residence permit. Such a legal entitlement did not exist in the applicant's case, as the stated purposes of residence were <strong data-start=\"4065\" data-end=\"4086\">Target regulations<\/strong> which grant the authorities discretionary powers (Sections 16a, 16f, 19c AufenthG).<\/p>\n<h4 data-start=\"4177\" data-end=\"4257\"><span class=\"ez-toc-section\" id=\"d_Unionsrechtliche_und_verwaltungspraktische_Einwendungen_unbeachtlich\"><\/span><strong data-start=\"4182\" data-end=\"4257\">d. Objections under Union law and administrative practice are irrelevant<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p data-start=\"4259\" data-end=\"4553\">The court expressly clarifies that EU law regulations - in particular the Visa Code (EC Regulation 810\/2009) and the Schengen Implementation Convention (CISA) - must also be applied. <strong data-start=\"4437\" data-end=\"4485\">do not justify a claim for visa exemption<\/strong>if national regulations clearly regulate the visa requirement.<\/p>\n<p data-start=\"4555\" data-end=\"4909\">Even the entry of the extended visa in the <strong data-start=\"4608\" data-end=\"4623\">Category D<\/strong> (national visa) in the visa database or information in internal administrative regulations of the immigration authorities <strong data-start=\"4746\" data-end=\"4780\">No position of trust<\/strong>. These internal regulations are <strong data-start=\"4813\" data-end=\"4847\">not binding for the courts<\/strong> and are not able to influence the legal interpretation.<\/p>\n<h3 data-start=\"4911\" data-end=\"4946\"><span class=\"ez-toc-section\" id=\"4_Bedeutung_fur_die_Praxis\"><\/span><strong data-start=\"4915\" data-end=\"4946\">4. significance for practice<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"4948\" data-end=\"5531\">The decision of the OVG Berlin-Brandenburg confirms the restrictive case law on the <strong data-start=\"5035\" data-end=\"5067\">Conversion of Schengen visas<\/strong> in residence permits under national law. A stay on the basis of a Schengen visa - even if it is extended to 180 days - opens up the following possibilities <strong data-start=\"5214\" data-end=\"5270\">No option for a residence permit in Germany<\/strong>.
