{"id":13147,"date":"2026-02-14T11:03:26","date_gmt":"2026-02-14T11:03:26","guid":{"rendered":"https:\/\/www.mth-partner.de\/?p=13147"},"modified":"2026-02-14T11:03:26","modified_gmt":"2026-02-14T11:03:26","slug":"mietrecht-eigenbedarf-auch-fuer-die-zweitwohnung-reicht-kultur-und-familie","status":"publish","type":"post","link":"https:\/\/www.mth-partner.de\/en\/tenancy-law-personal-use-also-for-the-second-home-is-enough-culture-and-family\/","title":{"rendered":"Tenancy law: personal use also for the second home - is \u201eculture and family\u201c enough?"},"content":{"rendered":"<p class=\"isSelectedEnd\"><strong>Hamburg Regional Court - Judgement of 10 June 2025 - Ref. 311 S 4\/25<\/strong><br \/>\n<strong>Previous instance:<\/strong> Hamburg District Court, judgement of 22\/11\/2024 - 21 C 401\/23<br \/>\n<strong>Legal force:<\/strong> final (appeal not authorised)<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Eigenbedarf_auch_fur_die_Zweitwohnung_%E2%80%93_reicht_%E2%80%9EKultur_und_Familie%E2%80%9C\"><\/span>Own use also for the second home - is \u201eculture and family\u201c enough?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"isSelectedEnd\">Many people assume that a termination for personal use only applies if the landlord needs the flat as their main residence.<\/p>\n<p class=\"isSelectedEnd\">The <strong>Hamburg District Court<\/strong> clarified in its judgement of 10\/06\/2025: Use as a second home can also justify personal use within the meaning of Section 573 (2) No. 2 BGB - if there are comprehensible and reasonable reasons.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Der_Fall_Zweitwohnung_fur_Hamburg-Aufenthalte\"><\/span>The case: Second home for stays in Hamburg<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"isSelectedEnd\">The plaintiffs wanted to use the flat themselves in the future in order to spend the night there during regular stays in Hamburg - especially for cultural events and family gatherings.<\/p>\n<p class=\"isSelectedEnd\">The local court had confirmed the termination for personal use. The regional court rejected the tenant's appeal.<\/p>\n<p class=\"isSelectedEnd\">The decisive factor was:<\/p>\n<ul data-spread=\"false\">\n<li>\n<p class=\"isSelectedEnd\">The utilisation request was serious.<\/p>\n<\/li>\n<li>\n<p class=\"isSelectedEnd\">The reasons were reasonable and understandable.<\/p>\n<\/li>\n<li>\n<p class=\"isSelectedEnd\">The flat was not oversized for the intended purpose.<\/p>\n<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">A landlord does not have to be told that there are also cultural offerings at the primary residence.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Anforderungen_an_die_Kundigungsbegrundung\"><\/span>Requirements for the grounds for cancellation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"isSelectedEnd\">The court also clarifies:<\/p>\n<p class=\"isSelectedEnd\">The notice of termination must state the tenant's own requirements in such concrete terms that the tenant can identify them and base their defence on them (Section 573 (3) BGB).<\/p>\n<p class=\"isSelectedEnd\">However, it does not have to contain all the details. Supplementary statements in the process are permissible as long as they do not replace the core already mentioned.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Harteeinwand_nach_%C2%A7_574_BGB\"><\/span>Objection of hardship according to \u00a7 574 BGB<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"isSelectedEnd\">The tenant cited health problems and a lack of alternative accommodation.<\/p>\n<p class=\"isSelectedEnd\">The court denied undue hardship:<\/p>\n<ul data-spread=\"false\">\n<li>\n<p class=\"isSelectedEnd\">There was no current evidence of adverse health effects.<\/p>\n<\/li>\n<li>\n<p class=\"isSelectedEnd\">Concrete and consistent efforts to find alternative accommodation were not substantiated.<\/p>\n<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">However, the regional court granted a deadline for eviction until 31 July 2025 - in view of the tight situation on the Hamburg housing market.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Einordnung_fur_die_Praxis\"><\/span>Categorisation for practical use<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"isSelectedEnd\">The decision shows:<\/p>\n<ul data-spread=\"false\">\n<li>\n<p class=\"isSelectedEnd\">Personal use is not limited to the main residence.<\/p>\n<\/li>\n<li>\n<p class=\"isSelectedEnd\">A regularly used second home may also be sufficient.<\/p>\n<\/li>\n<li>\n<p class=\"isSelectedEnd\">The benchmark is not an \u201eoptimality comparison\u201c, but the absence of abuse of rights.<\/p>\n<\/li>\n<li>\n<p class=\"isSelectedEnd\">Objections to hardship must be substantiated in detail and up to date.<\/p>\n<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">The courts do not examine whether the utilisation request is \u201eparticularly necessary\u201c - but whether it is serious and comprehensible.<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"size-full wp-image-7019 aligncenter\" src=\"https:\/\/www.mth-partner.de\/wp-content\/uploads\/Eigenbedarf.png\" alt=\"For whom may I register personal use?\" width=\"982\" height=\"560\" srcset=\"https:\/\/www.mth-partner.de\/wp-content\/uploads\/Eigenbedarf.png 982w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/Eigenbedarf-600x342.png 600w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/Eigenbedarf-250x143.png 250w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/Eigenbedarf-700x399.png 700w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/Eigenbedarf-768x438.png 768w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/Eigenbedarf-120x68.png 120w\" sizes=\"(max-width: 982px) 100vw, 982px\" \/><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Fazit\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"isSelectedEnd\">The Hamburg Regional Court reinforces the line of case law: The landlord's intention to use the property for his own purposes is only subject to an abuse check, not an appropriateness check.<\/p>\n<p class=\"isSelectedEnd\">Cultural and family motives can also be viable personal requirements - even in the case of a second home.<\/p>","protected":false},"excerpt":{"rendered":"<p>LG Hamburg confirms: Use as a second home for cultural visits and family gatherings can also justify personal use within the meaning of Section 573 (2) No. 2 BGB.<\/p>","protected":false},"author":4,"featured_media":13148,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[43],"tags":[],"class_list":["post-13147","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-mietrecht-rechtsanwalt"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Mietrecht: Eigenbedarf auch f\u00fcr die Zweitwohnung \u2013 reicht \u201eKultur und Familie\u201c? - Rechtsanwaltskanzlei\u00a0Tieben<\/title>\n<meta name=\"description\" content=\"Eigenbedarf auch f\u00fcr Zweitwohnung zul\u00e4ssig.
