Under \u00a7 4 of the German Nationality Act (Staatsangeh\u00f6rigkeitsgesetz \u2014 StAG), if at least one parent was a German citizen at the time of a child's birth, that child acquires German citizenship by operation of law \u2014 regardless of birthplace.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Das_Wichtigste_auf_einen_Blick\"><\/span><b>Key takeaways<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><b>You may already be a German citizen<\/b><span style=\"font-weight: 400;\">, without knowing it. Often the realisation begins with a document \u2014 a grandmother's birth certificate, an old passport, a letter from a consulate. Sometimes it begins with a question from a relative who has already been through the process.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The legal answer depends on a chain of documented facts: dates of birth, dates of marriage, the sex of the<\/span><span style=\"font-weight: 400;\">r<\/span><span style=\"font-weight: 400;\"> German ancestors and the question of whether a legal event has broken the chain. The rules have changed repeatedly over the last century. They are not intuitive. But they are precise and can be analysed with a high degree of certainty as soon as the relevant data is available.<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">Specific question? Nationality is a legal status, not a genetic finding.<\/span><\/li>\n<li><b> Can you trace an unbroken parent-child line from this ancestor to you?<\/b><span style=\"font-weight: 400;\"> Each person in the chain must be the child of the previous one. Marriage alone does not confer citizenship.<\/span><\/li>\n<li><b> Has anyone in this lineage been naturalised in another country before the birth of their child?<\/b><span style=\"font-weight: 400;\"> If so, the chain is probably broken at this point. That is the crucial question. The procedure serves to document an existing legal status.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Das_Grundprinzip_Ius_sanguinis\"><\/span><b>The core principle: <\/b><b><i>Ius sanguinis<\/i><\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">German citizenship law is based on descent, not on the place of birth. A child of a German citizen acquires German citizenship at birth, automatically, by law - whether in Berlin, Boston, S\u00e3o Paulo or Sydney. No application required. No residence in Germany. This principle has applied since <\/span><i><span style=\"font-weight: 400;\">Reich and Nationality Act<\/span><\/i><span style=\"font-weight: 400;\"> (RuStAG) of 1913 and continues to exist under the current StAG.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The question is therefore always: <\/span><b>Was at least one parent a German citizen at the time of your birth?<\/b><span style=\"font-weight: 400;\"> And if that is unsafe: <\/span><b>Was your parent the child of a German citizen at the time of birth?<\/b><span style=\"font-weight: 400;\"> The chain is followed backwards, generation after generation, until an ancestor is reached whose nationality is established.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The determination of German citizenship by descent is not an \u201eapplication.\u201c If the chain is intact, you already have German citizenship. The administrative procedure - the <\/span><i><span style=\"font-weight: 400;\">Determination of German citizenship<\/span><\/i><span style=\"font-weight: 400;\"> - serves as proof of an existing legal status. The standard of proof of the Federal Office of Administration (BVA): <\/span><i><span style=\"font-weight: 400;\">probability bordering on certainty<\/span><\/i><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Die_Reform_2024_Doppelte_Staatsangehorigkeit\"><\/span><b>The 2024 reform: dual citizenship now permitted<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Until 27 June 2024, the following applied: anyone who voluntarily acquired a foreign nationality automatically lost their German citizenship - provided no <\/span><i><span style=\"font-weight: 400;\">Retention authorisation<\/span><\/i><span style=\"font-weight: 400;\"> was available. Many emigrants and their descendants were affected without realising it.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><b>Nationality Modernisation Act (StARModG)<\/b><span style=\"font-weight: 400;\">, in force since 27 June 2024, has lifted this restriction (see<\/span><a href=\"https:\/\/www.auswaertiges-amt.de\/de\/newsroom\/stag-reform\/2664476\"> <span style=\"font-weight: 400;\">Federal Foreign Office: The new citizenship law<\/span><\/a><span style=\"font-weight: 400;\">). Germany now allows multiple nationality without restriction.<\/span><\/p>\n<p><b>The reform does not apply retroactively.<\/b><span style=\"font-weight: 400;\"> This is the most important restriction. If an ancestor was naturalised before 27 June 2024, the resulting loss of German citizenship remains in place. The reform protects future acquisitions of foreign citizenship. It does not reverse past losses. Whether the chain has been retained in your family depends solely on the naturalisation and birth dates in each generation - a question of fact that must be answered on the basis of documents.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Die_Generationenanalyse\"><\/span><b>Who qualifies: The generational analysis<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<\/p>\n<p><img decoding=\"async\" class=\"size-full wp-image-13164 aligncenter\" src=\"https:\/\/www.mth-partner.de\/wp-content\/uploads\/timeline-of-key-dates.webp\" alt=\"Timeline of key dates in Gernan nationality law\" width=\"1000\" height=\"667\" srcset=\"https:\/\/www.mth-partner.de\/wp-content\/uploads\/timeline-of-key-dates.webp 1000w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/timeline-of-key-dates-300x200.webp 300w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/timeline-of-key-dates-768x512.webp 768w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/timeline-of-key-dates-18x12.webp 18w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><\/p>\n<p>\n<h3><span class=\"ez-toc-section\" id=\"Elternteil_war_deutsch_%E2%80%93_Geburt_ab_01011975\"><\/span><b>Parent was German - birth after 01.01.1975<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Anyone who was born on or after 1 January 1975 and had at least one German parent automatically acquired citizenship - regardless of the parents' marital status and the gender of the German parent.<\/span><\/p>\n<p><b>Required documents:<\/b><span style=\"font-weight: 400;\"> Proof of the parent's nationality (birth certificate, passport or own chain of descent) and own birth certificate.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">My client Mrs S. was born on 10 May 1988 in S\u00e3o Paulo, Brazil. Her father was a German citizen. Her parents were not married. Since Mrs S. was born after the<\/span> <span style=\"font-weight: 400;\">01.01.1975 and one of her parents was German, she automatically acquired German citizenship at birth - regardless of her parents' marital status. She had her own birth certificate + proof of her father's German citizenship (passport) as proof. No naturalisation was required here - she had been German since birth.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Geburt_vor_dem_01011975_%E2%80%93_Geschlechterdiskriminierung\"><\/span><b>Birth before 1 January 1975 - Gender discrimination<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Before 1975, German law treated the nationality of mother and father differently:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With <\/span><b>marital birth<\/b><span style=\"font-weight: 400;\"> between 01.01.1914 and 31.12.1974: Only the father's nationality was passed on. A German mother who was married to a foreign father could not pass on her nationality to the child. This rule applied during the first twenty-five years of the Federal Republic of Germany and is the most common reason for broken chains in American and Canadian families.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With <\/span><b>illegitimate birth<\/b><span style=\"font-weight: 400;\"> Before 1 July 1993: Only the mother could confer citizenship. A German father who was not married to the mother could not, in principle, do so unless the child was legitimised under the conditions of the applicable law.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These rules are now recognised as discriminatory. The antidote: <\/span><b>\u00a7 5 StAG<\/b><span style=\"font-weight: 400;\"> - Acquisition by declaration.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Staatsangehorigkeit_uber_Groseltern\"><\/span><b>Nationality via grandparents<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">There is no independent \u201egrandparent route\u201c. Citizenship \u201evia grandparents\u201c means that the chain has remained intact generation after generation - from grandparent to parent to child, with each link being checked independently.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If your German grandparent passed on citizenship to your parent and your parent was still German at the time of your birth, you have German citizenship. If the chain was interrupted at any point - most frequently by naturalisation of an ancestor - the grandparent connection alone is not sufficient. German law does not allow you to skip a generation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">My client, Mr T., was born in 1968 in Boise, Idaho (USA). His mother was a German citizen and his father was US-American. His parents were married.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the legal situation at the time, only the father could pass on German citizenship in the case of marital birth. The German mother was excluded from passing it on. Mr T. therefore did not acquire German citizenship at birth - solely because of this gender-related disadvantage.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">I prepared a declaration for Mr T. in accordance with \u00a7 5 StAG and submitted it to the Federal Office of Administration in Cologne. After examination by the competent citizenship authority, the acquisition was confirmed.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mr T. is now a German citizen - not through naturalisation, but through the statutory compensation for earlier discrimination.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Staatsangehorigkeit_uber_Urgroseltern\"><\/span><b>Nationality via great-grandparents<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/p>\n<p><img decoding=\"async\" class=\"size-full wp-image-13167 aligncenter\" src=\"https:\/\/www.mth-partner.de\/wp-content\/uploads\/Citizenship-chain.webp\" alt=\"Citizenship chain\" width=\"667\" height=\"1000\" srcset=\"https:\/\/www.mth-partner.de\/wp-content\/uploads\/Citizenship-chain.webp 667w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/Citizenship-chain-200x300.webp 200w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/Citizenship-chain-8x12.webp 8w\" sizes=\"(max-width: 667px) 100vw, 667px\" \/><\/p>\n<p>\n<p><span style=\"font-weight: 400;\">The same chain analysis, but the difficulty increases with each generation. Cases with great-grandparents require careful historical reconstruction. Decisive variables: Did the great-grandparent still have German citizenship when the grandparent was born? Did they naturalise abroad beforehand? Did the emigration take place before 1914, and do the automatic loss provisions of \u00a7 21 RuStAG apply?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These cases are often misjudged by applicants when they rely solely on genealogical records without understanding the legal implications of certain dates. The difference between a promising claim and no claim can depend on the precise sequence of a naturalisation certificate and a birth certificate - sometimes by weeks.<\/span><\/p>\n<p><a href=\"https:\/\/www.mth-partner.de\/en\/german-nationality-by-descent-through-great-grandparents\/\">German citizenship through great-grandparents<\/a><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Auswanderung_vor_1914\"><\/span><b>Emigration before 1914<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\"> 21 of the <\/span><i><span style=\"font-weight: 400;\">Reich and Nationality Act<\/span><\/i><span style=\"font-weight: 400;\"> (RuStAG) of 1913 stipulated that Germans who lived abroad for more than ten years without registering with a German consulate could automatically lose their citizenship. This provision concerned the great wave of emigration to America, South Africa and Australasia in the late 19th and early 20th centuries.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Whether \u00a7 21 RuStAG actually applied in individual cases depends on the exact date of emigration, consular registration and any naturalisation in the destination country. These cases require archival research - registry office documents, church records, passenger lists, consular archives and naturalisation files - often in several countries. The quality of German administrative documentation from this period is generally excellent, but locating the relevant archives can take considerable time.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"%C2%A7_5_StAG_%E2%80%93_Erwerb_durch_Erklarung\"><\/span><b>\u00a7 Section 5 StAG - Acquisition by declaration<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">If the chain of descent has been interrupted solely because of the gender-related rules described above, then<\/span><a href=\"https:\/\/www.mth-partner.de\/en\/naturalisation-5-day-acquisition-of-german-citizenship-by-declaration\/\"> <span style=\"font-weight: 400;\">\u00a7 5 StAG an antidote<\/span><\/a><span style=\"font-weight: 400;\">. Affected persons and their descendants can <a href=\"https:\/\/www.mth-partner.de\/en\/naturalisation-5-day-acquisition-of-german-citizenship-by-declaration\/\">German citizenship by declaration<\/a> to the competent authority. No language test, no residence in Germany, no naturalisation test.<\/span><\/p>\n<p><b>The four case groups<\/b><span style=\"font-weight: 400;\"> (all require birth after 23 May 1949):<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Child of a German parent who did not acquire citizenship at birth due to discriminatory rules<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Person whose German mother lost her citizenship through marriage to a foreigner before 1 April 1953<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Person who lost German citizenship by legitimisation before 01.04.1953<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Descendants of persons from groups 1 to 3<\/span><\/li>\n<\/ol>\n<p><b>Deadline: 19 August 2031.<\/b><span style=\"font-weight: 400;\"> The declaration must be submitted to the competent authority by this date. <\/span><i><span style=\"font-weight: 400;\">received<\/span><\/i><span style=\"font-weight: 400;\"> not just sent off. Obtaining documents from German and foreign archives routinely takes 12 to 18 months. It is advisable to start no later than 2028. Details on the case groups and the procedure in my<\/span><a href=\"https:\/\/www.mth-partner.de\/en\/naturalisation-5-day-acquisition-of-german-citizenship-by-declaration\/\"> <span style=\"font-weight: 400;\">detailed article on \u00a7 5 StAG<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">My client, Mrs R., was born in 1972 in Asunci\u00f3n, Paraguay. Her mother was a German national, but had married a Paraguayan national before her birth. According to the legal situation at the time, the mother could not pass on her German nationality in the event of a marital birth.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The chain of descent was interrupted solely because of this gender-related regulation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">I prepared a declaration for Mrs R. in accordance with \u00a7 5 StAG and submitted it to the competent authority. Language skills, residence in Germany or a naturalisation test were not required.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The acquisition was confirmed following an official review.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"> Mrs R. is now a German citizen - her children are also entitled to make declarations as descendants.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The decisive factor was that the declaration was received on time.
