It creates legal stability, reduces the pressure to extend and provide evidence and in many cases opens up better options when changing employer, financing plans or family planning.<\/p>\n<p data-start=\"500\" data-end=\"770\">This article gives a <strong data-start=\"526\" data-end=\"584\">legally sound and at the same time readable overview<\/strong> on the current legal requirements (as at 19 December 2025) - both for potential clients and for colleagues in legal practice.<\/p>\n<h2 data-start=\"777\" data-end=\"863\"><span class=\"ez-toc-section\" id=\"1_Was_ist_die_Niederlassungserlaubnis_%E2%80%93_und_wofur_wird_sie_in_der_Praxis_benotigt\"><\/span>1 What is a settlement permit - and what is it needed for in practice?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"865\" data-end=\"1176\">The <strong data-start=\"869\" data-end=\"896\">Settlement permit<\/strong> is a <strong data-start=\"905\" data-end=\"939\">Permanent residence permit<\/strong>. It is not \u201eautomatically\u201c associated with every stay, but must be <strong data-start=\"1014\" data-end=\"1027\">requested<\/strong> and from the foreigners authority <strong data-start=\"1057\" data-end=\"1068\">issued<\/strong> be made. Legally important: ancillary provisions are only permitted where expressly authorised by law.<\/p>\n<p data-start=\"1178\" data-end=\"1211\"><strong data-start=\"1178\" data-end=\"1211\">Typical practical advantages:<\/strong><\/p>\n<ul data-start=\"1212\" data-end=\"1582\">\n<li data-start=\"1212\" data-end=\"1300\">\n<p data-start=\"1214\" data-end=\"1300\"><strong data-start=\"1214\" data-end=\"1238\">Permanent status<\/strong> instead of recurring extensions of the residence permit<\/p>\n<\/li>\n<li data-start=\"1301\" data-end=\"1385\">\n<p data-start=\"1303\" data-end=\"1385\">often <strong data-start=\"1307\" data-end=\"1328\">More flexibility<\/strong> for career changes (depending on previous title)<\/p>\n<\/li>\n<li data-start=\"1386\" data-end=\"1476\">\n<p data-start=\"1388\" data-end=\"1476\">frequently <strong data-start=\"1395\" data-end=\"1418\">Better plannability<\/strong> for loans\/property, change of employer, family reunification<\/p>\n<\/li>\n<li data-start=\"1477\" data-end=\"1582\">\n<p data-start=\"1479\" data-end=\"1582\">Less dependence on individual residence permit purposes (studies, specific employment, etc.)<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1584\" data-end=\"1606\"><strong data-start=\"1584\" data-end=\"1606\">Delimitation (short):<\/strong><\/p>\n<ul data-start=\"1607\" data-end=\"1960\">\n<li data-start=\"1607\" data-end=\"1703\">\n<p data-start=\"1609\" data-end=\"1703\"><strong data-start=\"1609\" data-end=\"1633\">Residence permit<\/strong>temporary, earmarked (e.g. employment, education, family).<\/p>\n<\/li>\n<li data-start=\"1704\" data-end=\"1790\">\n<p data-start=\"1706\" data-end=\"1790\"><strong data-start=\"1706\" data-end=\"1733\">Settlement permit<\/strong>unlimited, more \u201edecoupled\u201c from the purpose of residence.<\/p>\n<\/li>\n<li data-start=\"1791\" data-end=\"1960\">\n<p data-start=\"1793\" data-end=\"1960\"><strong data-start=\"1793\" data-end=\"1845\">EU permanent residence permit (Section 9a AufenthG)<\/strong>also open-ended, with additional EU mobility reference; not identical, but comparable in many respects.<\/p>\n<\/li>\n<\/ul>\n<h2 data-start=\"1967\" data-end=\"2035\"><span class=\"ez-toc-section\" id=\"2_Der_Regelfall_nach_%C2%A7_9_AufenthG_Voraussetzungen_und_Nachweise\"><\/span>2. the standard case according to \u00a7 9 AufenthG: Requirements and evidence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"2037\" data-end=\"2336\">The \u201eclassic\u201c route to a settlement permit is \u00a7 9 AufenthG. The requirements are regulated there as a catalogue. In practice, applications rarely fail due to \u201eone big problem\u201c, but often due to <strong data-start=\"2240\" data-end=\"2259\">Verification details<\/strong> (insurance histories, gaps, incorrect certificates, unexplained periods).<\/p>\n<h3 data-start=\"2338\" data-end=\"2406\"><span class=\"ez-toc-section\" id=\"21_Die_neun_Kernvoraussetzungen_nach_%C2%A7_9_Abs_2_Satz_1_AufenthG\"><\/span>2.1 The nine core requirements in accordance with Section 9 (2) sentence 1 AufenthG<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"2408\" data-end=\"2494\">A settlement permit must be issued if the following points are met, among others:<\/p>\n<ol data-start=\"2496\" data-end=\"4632\">\n<li data-start=\"2496\" data-end=\"2666\">\n<p data-start=\"2499\" data-end=\"2666\"><strong data-start=\"2499\" data-end=\"2547\">Five years possession of a residence permit<\/strong><br data-start=\"2547\" data-end=\"2550\" \/>In principle, the previous period of residence with a residence permit is decisive; see below for details on crediting.<\/p>\n<\/li>\n<li data-start=\"2668\" data-end=\"3058\">\n<p data-start=\"2671\" data-end=\"3058\"><strong data-start=\"2671\" data-end=\"2702\">Secure livelihood<\/strong><br data-start=\"2702\" data-end=\"2705\" \/>The livelihood is considered secure if it <strong data-start=\"2756\" data-end=\"2815\">including adequate health insurance cover<\/strong> can be met without recourse to public funds. Certain benefits are not considered harmful utilisation (e.g. child benefit, child supplement, parental allowance - the exact classification must be carefully examined in each individual case).<\/p>\n<\/li>\n<li data-start=\"3060\" data-end=\"3379\">\n<p data-start=\"3063\" data-end=\"3379\"><strong data-start=\"3063\" data-end=\"3127\">60 months pension insurance periods \/ comparable provision<\/strong><br data-start=\"3127\" data-end=\"3130\" \/>At least 60 months of compulsory or voluntary contributions to statutory pension insurance or equivalent entitlements are required. Periods of childcare or home care are taken into account accordingly in accordance with the law.<\/p>\n<\/li>\n<li data-start=\"3381\" data-end=\"3759\">\n<p data-start=\"3384\" data-end=\"3759\"><strong data-start=\"3384\" data-end=\"3459\">No conflicting reasons of public safety or order<\/strong><br data-start=\"3459\" data-end=\"3462\" \/>In contrast to \u201erigid penalty limits\u201c, the standard works with a <strong data-start=\"3526\" data-end=\"3545\">Overall assessment<\/strong> (severity\/type of offence, danger, length of stay, ties in Germany). In counselling practice, this is often decisive, <strong data-start=\"3680\" data-end=\"3687\">what<\/strong> has happened, <strong data-start=\"3702\" data-end=\"3710\">when<\/strong> it happened and <strong data-start=\"3731\" data-end=\"3738\">like<\/strong> the authority recognises.<\/p>\n<\/li>\n<li data-start=\"3761\" data-end=\"3929\">\n<p data-start=\"3764\" data-end=\"3929\"><strong data-start=\"3764\" data-end=\"3811\">Employment permitted (if employee)<\/strong><br data-start=\"3811\" data-end=\"3814\" \/>What is meant is not \u201eany job\u201c, but the legal admissibility of gainful employment in the specific status.<\/p>\n<\/li>\n<li data-start=\"3931\" data-end=\"4083\">\n<p data-start=\"3934\" data-end=\"4083\"><strong data-start=\"3934\" data-end=\"4004\">Other authorisations required for permanent gainful employment<\/strong><br data-start=\"4004\" data-end=\"4007\" \/>Relevant e.g. for regulated professions (licence to practise\/professional authorisation).<\/p>\n<\/li>\n<li data-start=\"4085\" data-end=\"4197\">\n<p data-start=\"4088\" data-end=\"4197\"><strong data-start=\"4088\" data-end=\"4137\">Sufficient knowledge of the German language<\/strong><br data-start=\"4137\" data-end=\"4140\" \/>\u201eSufficient\u201c corresponds to the legal level <strong data-start=\"4190\" data-end=\"4196\">B1<\/strong>.<\/p>\n<\/li>\n<li data-start=\"4199\" data-end=\"4356\">\n<p data-start=\"4202\" data-end=\"4356\"><strong data-start=\"4202\" data-end=\"4285\">Basic knowledge of the legal and social order and living conditions<\/strong><br data-start=\"4285\" data-end=\"4288\" \/>Often proven via integration course\/\u201eLiving in Germany\u201c.<\/p>\n<\/li>\n<li data-start=\"4358\" data-end=\"4632\">\n<p data-start=\"4361\" data-end=\"4632\"><strong data-start=\"4361\" data-end=\"4387\">Sufficient living space<\/strong><br data-start=\"4387\" data-end=\"4390\" \/>The question of living space is often less of a \u201esquare metre maths\u201c than a <strong data-start=\"4461\" data-end=\"4498\">verifiable, legally secured<\/strong> Housing status (tenancy agreement, household size, actual use). The term \u201esufficient living space\u201c is defined in more detail by law.<\/p>\n<\/li>\n<\/ol>\n<h3 data-start=\"4634\" data-end=\"4708\"><span class=\"ez-toc-section\" id=\"22_Praxisnahe_Nachweis-Checkliste_ohne_Anspruch_auf_Vollstandigkeit\"><\/span>2.2 Practical verification checklist (not exhaustive)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"4710\" data-end=\"4798\">Typically, the foreigners authority (depending on the municipality and case) requires, among other things<\/p>\n<ul data-start=\"4799\" data-end=\"5323\">\n<li data-start=\"4799\" data-end=\"4844\">\n<p data-start=\"4801\" data-end=\"4844\">Passport\/passport replacement, current residence permit<\/p>\n<\/li>\n<li data-start=\"4845\" data-end=\"4903\">\n<p data-start=\"4847\" data-end=\"4903\">Registration certificate, tenancy agreement\/landlord's confirmation<\/p>\n<\/li>\n<li data-start=\"4904\" data-end=\"4994\">\n<p data-start=\"4906\" data-end=\"4994\">Proof of income (payslips), employment contract, employer's certificate if applicable<\/p>\n<\/li>\n<li data-start=\"4995\" data-end=\"5025\">\n<p data-start=\"4997\" data-end=\"5025\">Proof of health insurance<\/p>\n<\/li>\n<li data-start=\"5026\" data-end=\"5078\">\n<p data-start=\"5028\" data-end=\"5078\">Pension insurance history\/proof of contributions (DRV)<\/p>\n<\/li>\n<li data-start=\"5079\" data-end=\"5133\">\n<p data-start=\"5081\" data-end=\"5133\">Language certificate (B1) or proof of integration course<\/p>\n<\/li>\n<li data-start=\"5134\" data-end=\"5219\">\n<p data-start=\"5136\" data-end=\"5219\">Proof of \u201eLiving in Germany\u201c \/ integration course completion (depending on the constellation)<\/p>\n<\/li>\n<li data-start=\"5220\" data-end=\"5323\">\n<p data-start=\"5222\" data-end=\"5323\">for self-employed persons: tax assessments, BWA, profit calculations, health insurance, pension schemes, etc.<\/p>\n<\/li>\n<\/ul>\n<h2 data-start=\"5330\" data-end=\"5392\"><span class=\"ez-toc-section\" id=\"3_Ausnahmen_und_Erleichterungen_im_Rahmen_des_%C2%A7_9_AufenthG\"><\/span>3. exceptions and facilitations within the framework of \u00a7 9 AufenthG<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"5394\" data-end=\"5539\">\u00a7 Section 9 AufenthG not only contains requirements, but also <strong data-start=\"5453\" data-end=\"5495\">Facilitations and exemptions<\/strong>, which are often decisive in practice.<\/p>\n<h3 data-start=\"5541\" data-end=\"5621\"><span class=\"ez-toc-section\" id=\"31_Sprache_%E2%80%9ELeben_in_Deutschland%E2%80%9C_Integrationskurs_als_Schlusselnachweis\"><\/span>3.1 Language &amp; \u201eLiving in Germany\u201c: Integration course as key evidence<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"5623\" data-end=\"5883\">The language (No. 7) and basic knowledge (No. 8) requirements are deemed to have been met if a <strong data-start=\"5725\" data-end=\"5771\">Integration course successfully completed<\/strong> was created. This is practically important because <strong data-start=\"5817\" data-end=\"5825\">two<\/strong> requirements can be secured in one step.<\/p>\n<h3 data-start=\"5885\" data-end=\"5985\"><span class=\"ez-toc-section\" id=\"32_Absehen_von_Voraussetzungen_bei_KrankheitBehinderung_%E2%80%93_und_zur_Vermeidung_unbilliger_Harten\"><\/span>3.2 Waiver of requirements in the event of illness\/disability - and to avoid undue hardship<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"5987\" data-end=\"6365\">The law allows the language and basic knowledge requirements to be waived if they are not met due to <strong data-start=\"6092\" data-end=\"6162\">physical, mental or psychological illness or disability<\/strong> cannot be fulfilled. In addition, \u201eincidentally\u201c can be used to <strong data-start=\"6229\" data-end=\"6255\">Avoidance of hardness<\/strong> The prerequisites must be disregarded - proper argumentation and documentation are crucial here.<\/p>\n<h3 data-start=\"6367\" data-end=\"6433\"><span class=\"ez-toc-section\" id=\"33_%E2%80%9EEinfache_mundliche_Verstandigung%E2%80%9C_als_Sonderkonstellation\"><\/span>3.3 \u201eSimple oral communication\u201c as a special constellation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"6435\" data-end=\"6763\">Furthermore, language\/basic knowledge may be waived if the person <strong data-start=\"6515\" data-end=\"6557\">communicate verbally in a simple way<\/strong> and <strong data-start=\"6567\" data-end=\"6599\">neither entitlement to participation<\/strong> There was still an integration course <strong data-start=\"6638\" data-end=\"6655\">Commitment<\/strong> was available for participation. This constellation is rather rare in practice, but highly relevant if it fits.<\/p>\n<h3 data-start=\"6765\" data-end=\"6812\"><span class=\"ez-toc-section\" id=\"34_Ehegattenregelung_%C2%A7_9_Abs_3_AufenthG\"><\/span>3.4 Spouse regulation (Section 9 (3) AufenthG)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"6814\" data-end=\"7213\">In the case of spouses living in a marital partnership, it is sufficient if certain requirements (in particular pension insurance periods and work-related authorisations) are met. <strong data-start=\"6989\" data-end=\"7014\">by a spouse<\/strong> be fulfilled. In addition, the pension insurance requirement can be waived if the applicant is undergoing training leading to a recognised qualification.<\/p>\n<h3 data-start=\"7215\" data-end=\"7266\"><span class=\"ez-toc-section\" id=\"35_Anrechnung_von_Zeiten_%C2%A7_9_Abs_4_AufenthG\"><\/span>3.5 Recognition of periods (Section 9 (4) AufenthG)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"7268\" data-end=\"7342\">Crediting rules are important for the 5-year pre-stay period, e.g:<\/p>\n<ul data-start=\"7343\" data-end=\"7633\">\n<li data-start=\"7343\" data-end=\"7461\">\n<p data-start=\"7345\" data-end=\"7461\">Previous periods with a residence permit\/settlement permit can be taken into account (with caps depending on the case).<\/p>\n<\/li>\n<li data-start=\"7462\" data-end=\"7522\">\n<p data-start=\"7464\" data-end=\"7522\">Certain stays abroad are recognised to a limited extent.<\/p>\n<\/li>\n<li data-start=\"7523\" data-end=\"7633\">\n<p data-start=\"7525\" data-end=\"7633\">Periods of legal residence for the purpose of studying or vocational training are <strong data-start=\"7606\" data-end=\"7620\">half<\/strong> credited.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"7635\" data-end=\"7814\">Especially with \u201epatchwork biographies\u201c (studies \u2192 job \u2192 change of title \u2192 parental leave \u2192 change of employer), this is often the point at which legal processing \u201esaves\u201c the application.<\/p>\n<h2 data-start=\"7821\" data-end=\"7912\"><span class=\"ez-toc-section\" id=\"4_Beschleunigter_Weg_fur_Fachkrafte_Niederlassungserlaubnis_nach_%C2%A7_18c_Abs_1_AufenthG\"><\/span>4 Accelerated path for skilled workers: Settlement permit in accordance with Section 18c (1) AufenthG<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"7914\" data-end=\"8031\">In addition to the standard case of \u00a7 9, there is a special case for <strong data-start=\"7971\" data-end=\"8006\">independent, often faster<\/strong> Path via \u00a7 18c AufenthG.<\/p>\n<h3 data-start=\"8033\" data-end=\"8099\"><span class=\"ez-toc-section\" id=\"41_Grundmodell_3_Jahre_Titel_36_Monate_Rentenbeitrage_B1\"><\/span>4.1 Basic model: 3 years title + 36 months pension contributions + B1<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"8101\" data-end=\"8168\">A skilled worker receives a permanent residence permit if, among other things:<\/p>\n<ul data-start=\"8170\" data-end=\"8742\">\n<li data-start=\"8170\" data-end=\"8268\">\n<p data-start=\"8172\" data-end=\"8268\"><strong data-start=\"8172\" data-end=\"8192\">for three years<\/strong> in possession of a residence permit according to <strong data-start=\"8232\" data-end=\"8263\">\u00a7\u00a7 18a, 18b, 18d or \u00a7 18g<\/strong> is,<\/p>\n<\/li>\n<li data-start=\"8269\" data-end=\"8381\">\n<p data-start=\"8271\" data-end=\"8381\">one <strong data-start=\"8277\" data-end=\"8293\">Workplace<\/strong> which may be occupied by it in accordance with the requirements of the aforementioned standards,<\/p>\n<\/li>\n<li data-start=\"8382\" data-end=\"8496\">\n<p data-start=\"8384\" data-end=\"8496\"><strong data-start=\"8384\" data-end=\"8408\">at least 36 months<\/strong> pension insurance contributions (or comparable expenses\/expectancies),<\/p>\n<\/li>\n<li data-start=\"8497\" data-end=\"8556\">\n<p data-start=\"8499\" data-end=\"8556\">about <strong data-start=\"8504\" data-end=\"8538\">sufficient knowledge of German<\/strong> has (<strong data-start=\"8548\" data-end=\"8554\">B1<\/strong>),<\/p>\n<\/li>\n<li data-start=\"8557\" data-end=\"8742\">\n<p data-start=\"8559\" data-end=\"8742\">and also fulfils certain requirements from \u00a7 9 Para. 2 Sentence 1 (in particular livelihood, safety\/order, employment permit, other permits, basic knowledge, living space).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"8744\" data-end=\"8933\">The system is important: Section 18c (1) \u201edraws on\u201c central elements from Section 9, but replaces the 5-year waiting period, for example, with <strong data-start=\"8874\" data-end=\"8885\">3 years<\/strong> and reduces the pension period to <strong data-start=\"8919\" data-end=\"8932\">36 months<\/strong>.<\/p>\n<h3 data-start=\"8935\" data-end=\"9010\"><span class=\"ez-toc-section\" id=\"42_Noch_schneller_nach_inlandischer_Qualifikation_2_Jahre_24_Monate\"><\/span>4.2 Even faster after domestic qualification: 2 years \/ 24 months<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"9012\" data-end=\"9039\">The deadlines are shortened:<\/p>\n<ul data-start=\"9040\" data-end=\"9126\">\n<li data-start=\"9040\" data-end=\"9080\">\n<p data-start=\"9042\" data-end=\"9080\">the 3-year period to <strong data-start=\"9065\" data-end=\"9076\">2 years<\/strong> and<\/p>\n<\/li>\n<li data-start=\"9081\" data-end=\"9126\">\n<p data-start=\"9083\" data-end=\"9126\">the 36-month pension period to <strong data-start=\"9112\" data-end=\"9125\">24 months<\/strong>,<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"9128\" data-end=\"9245\">if the specialist has a <strong data-start=\"9152\" data-end=\"9240\">successfully completed vocational training in Germany or a degree programme in Germany<\/strong> has.<\/p>\n<p data-start=\"9247\" data-end=\"9464\"><strong data-start=\"9247\" data-end=\"9271\">Practical tip:<\/strong> In this case, it is worthwhile preparing the training\/study certificates (degree certificate, certificate of exmatriculation, recognition if applicable) and the subsequent continuity of employment.<\/p>\n<h2 data-start=\"9471\" data-end=\"9563\"><span class=\"ez-toc-section\" id=\"5_Blaue_Karte_EU_Niederlassungserlaubnis_nach_%C2%A7_18c_Abs_2_AufenthG_21_oder_27_Monate\"><\/span>5 EU Blue Card: Settlement permit in accordance with Section 18c (2) AufenthG (21 or 27 months)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"9565\" data-end=\"9667\">For holders of the <strong data-start=\"9598\" data-end=\"9617\">EU Blue Card<\/strong> there are particularly practical time corridors:<\/p>\n<h3 data-start=\"9669\" data-end=\"9728\"><span class=\"ez-toc-section\" id=\"51_Regelfrist_27_Monate_Beschaftigung_Beitrage_A1\"><\/span>5.1 Standard period: 27 months of employment + contributions + A1<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"9730\" data-end=\"9780\">A settlement permit must be issued if<\/p>\n<ul data-start=\"9781\" data-end=\"10163\">\n<li data-start=\"9781\" data-end=\"9853\">\n<p data-start=\"9783\" data-end=\"9853\"><strong data-start=\"9783\" data-end=\"9807\">at least 27 months<\/strong> employment pursuant to \u00a7 18g was exercised,<\/p>\n<\/li>\n<li data-start=\"9854\" data-end=\"9947\">\n<p data-start=\"9856\" data-end=\"9947\">pension contributions (or comparable entitlements) can be proven for this period,<\/p>\n<\/li>\n<li data-start=\"9948\" data-end=\"10106\">\n<p data-start=\"9950\" data-end=\"10106\">central requirements from \u00a7 9 para. 2 sentence 1 are fulfilled (including livelihood, safety\/order, employment permit, basic
