In particular, the targeted promotion of immigration <strong data-start=\"390\" data-end=\"423\">highly qualified specialists<\/strong> a central role. This policy aims to strengthen the competitiveness of the German economy and counteract the shortage of skilled labour. Through a <strong data-start=\"591\" data-end=\"618\">Sustainable integration<\/strong> The aim is to strengthen social security by integrating qualified workers into the labour market and society.<\/p>\n<p data-start=\"735\" data-end=\"1368\">Within the legal framework, the Residence Act distinguishes between different <strong data-start=\"818\" data-end=\"849\">Types of residence permits<\/strong> for the purpose of gainful employment, each of which includes specific requirements and authorisations. In principle, there are temporary <strong data-start=\"982\" data-end=\"1008\">Residence permits<\/strong> (e.g. for specialists or researchers), special forms such as the <strong data-start=\"1071\" data-end=\"1089\">EU Blue Card<\/strong> for highly qualified employees with above-average salaries and permanent <strong data-start=\"1165\" data-end=\"1194\">Establishment licences<\/strong> for skilled workers under certain conditions. The type of title that is considered in each individual case depends on qualifications, employment offer and other criteria.<\/p>\n<h2 data-start=\"1370\" data-end=\"1451\"><span class=\"ez-toc-section\" id=\"Entwicklung_der_Regelungen_Blaue_Karte_EU_und_Fachkrafteeinwanderungsreformen\"><\/span>Development of the regulations: EU Blue Card and skilled labour immigration reforms<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"1453\" data-end=\"2407\">A significant innovation in German residence law was the <strong data-start=\"1516\" data-end=\"1550\">Introduction of the EU Blue Card<\/strong> The background to this was the EU Council's Highly Qualified Directive 2009\/50\/EC of 25 May 2009, which harmonised the conditions for entry and residence of third-country nationals for the purpose of highly qualified employment. The EU Blue Card represents a <strong data-start=\"1842\" data-end=\"1874\">Temporary residence permit<\/strong> (usually up to four years), which enables highly qualified specialists from third countries to stay in Germany for employment. With the EU Blue Card, foreign academics can work in Germany if they fulfil certain salary and qualification requirements and later receive a settlement permit under simplified conditions. The purpose of this measure was to attract internationally sought-after skilled workers to Germany and offer them long-term prospects.<\/p>\n<p data-start=\"2409\" data-end=\"3515\">With the entry into force of the <strong data-start=\"2435\" data-end=\"2470\">Skilled Labour Immigration Act<\/strong> On 1 March 2020, the provisions of Section 4 of the Residence Act were comprehensively revised and expanded. This reform brought considerable relief and new opportunities for labour migration. For example, the group of <strong data-start=\"2695\" data-end=\"2709\">Specialists<\/strong> The right of residence has been extended beyond academic specialists to include people with qualified vocational training (Sections 18a, 18b AufenthG). The previous bottleneck reference (i.e. the restriction to shortage occupations) and the priority review were largely abolished, so that skilled workers with recognised qualifications in <em data-start=\"3003\" data-end=\"3010\">each<\/em> qualified profession in Germany. New paths have also been created, such as a <strong data-start=\"3112\" data-end=\"3151\">Residence permit for training<\/strong> and for the recognition of foreign professional qualifications, as well as facilitating the transition from the asylum procedure to training or employment. Overall, the Skilled Immigration Act 2020 aimed to make the immigration of skilled workers more attractive and practical and to better align it with the needs of the German labour market.<\/p>\n<p data-start=\"3517\" data-end=\"4819\">The provisions were modernised again in the following years. In particular, the German legislator <strong data-start=\"3625\" data-end=\"3687\">2023 - as part of the implementation of Directive (EU) 2021\/1883<\/strong> (revised version of the Highly Qualified Persons\/Blue Card Directive) - the Residence Act was amended and extended once again. Most of these recent changes came into force on <strong data-start=\"3853\" data-end=\"3874\">18 November 2023<\/strong> and <strong data-start=\"3879\" data-end=\"3895\">1 March 2024<\/strong> will come into force (some parts on 1 June 2024) and aim to further facilitate access to the German labour market for foreign skilled workers. A key point of the 2023 reform is the introduction of a <strong data-start=\"4103\" data-end=\"4137\">points-based \u201eopportunity map\u201c<\/strong> for qualified job and training seekers from abroad, which enables a residence permit to search for a job in Germany even without a concrete job offer. In addition, the salary thresholds for the EU Blue Card have been lowered and the group of authorised persons expanded (e.g. certain experienced professionals without a university degree can now receive a Blue Card, provided they have comparable qualifications and a sufficient salary). Other changes include the simplified recognition of foreign professional qualifications (which now also includes <strong data-start=\"4714\" data-end=\"4727\">Domestically<\/strong> can take place) and the cancellation of the Western Balkans regulation in the Employment Ordinance.<\/p>\n<p data-start=\"4821\" data-end=\"5262\">The constant adjustments and extensions to the statutory provisions emphasise the importance of a <strong data-start=\"4929\" data-end=\"4987\">flexible and future-oriented immigration policy<\/strong>, which fulfils both the needs of the German economy and the legitimate interests of immigrants. Germany is continuously developing its right of residence for skilled workers and labour in order to remain attractive in the global competition for talent.<\/p>\n<h2 data-start=\"5264\" data-end=\"5326\"><span class=\"ez-toc-section\" id=\"Aufenthaltstitel_zum_Zweck_der_Erwerbstatigkeit_%E2%80%93_Uberblick\"><\/span>Residence permit for the purpose of gainful employment - overview<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"5328\" data-end=\"5600\">The following <strong data-start=\"5337\" data-end=\"5354\">Possibilities<\/strong> The Residence Act (Chapter 2, Section 4 AufenthG) provides that foreign nationals may <strong data-start=\"5440\" data-end=\"5501\">Residence in Germany for the purpose of gainful employment<\/strong> to make it possible. Here is an overview of the most important categories and respective residence permits:<\/p>\n<p data-start=\"5602\" data-end=\"5909\"><strong data-start=\"5602\" data-end=\"5658\">Residence titles for skilled workers with vocational training<\/strong> - This includes persons who have a <strong data-start=\"5697\" data-end=\"5772\">Domestic or recognised foreign qualified vocational training<\/strong> have concluded. In Germany you can <em data-start=\"5820\" data-end=\"5835\">as a specialist<\/em> work, in principle in any qualified employment. Example:<\/p>\n<ul data-start=\"5911\" data-end=\"6171\">\n<li data-start=\"5911\" data-end=\"6171\">\n<p data-start=\"5913\" data-end=\"6171\"><em data-start=\"5913\" data-end=\"5975\">Residence permit for a skilled worker with vocational training<\/em>, <strong data-start=\"5977\" data-end=\"5995\">\u00a7 Section 18a AufenthG<\/strong> - Issues a residence permit to a professionally qualified skilled worker to pursue an occupation corresponding to their qualifications (without any professional restrictions).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"6173\" data-end=\"6517\"><strong data-start=\"6173\" data-end=\"6246\">Residence permit for skilled workers with academic training (studies)<\/strong> - These titles are aimed at <strong data-start=\"6277\" data-end=\"6301\">University graduates<\/strong> and other academically qualified specialists. In addition to temporary residence permits, this group also has the option of permanent residence if they have special qualifications. These include<\/p>\n<ul data-start=\"6519\" data-end=\"8211\">\n<li data-start=\"6519\" data-end=\"6768\">\n<p data-start=\"6521\" data-end=\"6768\"><em data-start=\"6521\" data-end=\"6590\">Residence permit for a skilled worker with an academic qualification<\/em>, <strong data-start=\"6592\" data-end=\"6610\">\u00a7 Section 18b AufenthG<\/strong> - Residence permit for foreign academics to pursue qualified employment in Germany (corresponding to their university education).<\/p>\n<\/li>\n<li data-start=\"6769\" data-end=\"7123\">\n<p data-start=\"6771\" data-end=\"7123\"><em data-start=\"6771\" data-end=\"6811\">Settlement permit for skilled workers<\/em>, <strong data-start=\"6813\" data-end=\"6838\">\u00a7 Section 18c (1) AufenthG<\/strong> - One <strong data-start=\"6846\" data-end=\"6862\">indefinite<\/strong> Settlement permit, which is issued to a skilled worker if they have held a residence permit as a skilled worker for at least three years (e.g. in accordance with \u00a7 18a, 18b or 18d) and fulfil other integration criteria (e.g. pension contributions, language skills).<\/p>\n<\/li>\n<li data-start=\"7124\" data-end=\"7585\">\n<p data-start=\"7126\" data-end=\"7585\"><em data-start=\"7126\" data-end=\"7185\">Settlement permit for holders of an EU Blue Card<\/em>, <strong data-start=\"7187\" data-end=\"7212\">\u00a7 Section 18c (2) AufenthG<\/strong> - An unlimited settlement permit that can be issued to EU Blue Card holders after just 33 months (or 21 months if they can prove German language skills at B1 level). The prerequisite is that the Blue Card holder has been in qualified employment without interruption during this time and has paid into the pension insurance scheme.<\/p>\n<\/li>\n<li data-start=\"7586\" data-end=\"8211\">\n<p data-start=\"7588\" data-end=\"8211\"><em data-start=\"7588\" data-end=\"7646\">Settlement permit for highly qualified specialists<\/em>, <strong data-start=\"7648\" data-end=\"7673\">\u00a7 Section 18c (3) AufenthG<\/strong> - In special cases <strong data-start=\"7697\" data-end=\"7705\">shall<\/strong> highly qualified specialists with an academic education should be granted a settlement permit immediately. This applies in particular to <em data-start=\"7844\" data-end=\"7899\">Scientists with special expertise<\/em> or <em data-start=\"7905\" data-end=\"7947\">Teachers in a prominent position<\/em>, as long as their integration and livelihood appear to be secure. This exception enables top talents to obtain permanent status directly without having to stay for several years beforehand (although the state authorities may require approval).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"8213\" data-end=\"8574\"><strong data-start=\"8213\" data-end=\"8247\">Residence titles for research purposes<\/strong> - There are special residence permits for scientists and researchers that reflect the transposition of the EU Researchers Directive 2016\/801 into national law. These titles make it easier for research projects and academic staff to stay in Germany and to be mobile within the EU. These include<\/p>\n<ul data-start=\"8576\" data-end=\"10321\">\n<li data-start=\"8576\" data-end=\"8963\">\n<p data-start=\"8578\" data-end=\"8963\"><em data-start=\"8578\" data-end=\"8625\">Residence permit for the purpose of research<\/em>, <strong data-start=\"8627\" data-end=\"8652\">\u00a7 Section 18d (1) AufenthG<\/strong> - Issued to foreigners who have a <em data-start=\"8686\" data-end=\"8706\">Research project<\/em> at a recognised research institution in Germany (prerequisite is, among other things, a hosting agreement with the institution). This residence permit is usually <strong data-start=\"8894\" data-end=\"8910\">accelerated<\/strong> and also permits teaching activities.<\/p>\n<\/li>\n<li data-start=\"8964\" data-end=\"9282\">\n<p data-start=\"8966\" data-end=\"9282\"><em data-start=\"8966\" data-end=\"9066\">Residence permit for the purpose of research for a beneficiary of international protection in the EU<\/em>, <strong data-start=\"9068\" data-end=\"9093\">\u00a7 Section 18d (6) AufenthG<\/strong> - Special regulation that enables recognised beneficiaries of protection (persons entitled to asylum or refugees) from other EU countries to come to Germany for a research project.<\/p>\n<\/li>\n<li data-start=\"9283\" data-end=\"9735\">\n<p data-start=\"9285\" data-end=\"9735\"><em data-start=\"9285\" data-end=\"9348\">Residence permit for short-term mobility for researchers<\/em>, <strong data-start=\"9350\" data-end=\"9368\">\u00a7 Section 18e Residence Act<\/strong> - Applies to researchers who already hold a residence permit from another EU Member State and for <strong data-start=\"9475\" data-end=\"9506\">Short research stays<\/strong> (up to 180 days) want to come to Germany. The <strong data-start=\"9561\" data-end=\"9587\">Short-term mobility<\/strong> allows them to stay in Germany without a new lengthy visa procedure (a notification from the other EU country is sufficient).<\/p>\n<\/li>\n<li data-start=\"9736\" data-end=\"10321\">\n<p data-start=\"9738\" data-end=\"10321\"><em data-start=\"9738\" data-end=\"9807\">Residence permit for mobile researchers (stay over 180 days)<\/em>, <strong data-start=\"9809\" data-end=\"9834\">\u00a7 Section 18f (1) AufenthG<\/strong> - For longer research stays (more than 180 days, max. 1 year) by researchers with a residence permit from another EU country. A German residence permit is issued if certain requirements are met (including a valid passport and submission of the hosting agreement with the German research institution). This regulation allows <strong data-start=\"10188\" data-end=\"10216\">Long-term mobility<\/strong> of researchers within the EU without having to go through the full visa procedure from scratch.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"10323\" data-end=\"11121\"><strong data-start=\"10323\" data-end=\"10341\">EU Blue Card<\/strong> - The <strong data-start=\"10348\" data-end=\"10366\">EU Blue Card<\/strong> is a central residence permit for highly qualified skilled workers with a university degree. As mentioned above, it was introduced to attract academic specialists from non-EU countries to the German labour market. The EU Blue Card generally requires an above-average salary and a university degree (or comparable proof of qualification). It is initially issued for a limited period and entitles the holder to <strong data-start=\"10800\" data-end=\"10841\">employment commensurate with qualifications<\/strong> and can lead to an early settlement permit if employment continues (Section 18c (2) AufenthG). The Residence Act now differentiates between several types of EU Blue Card cases, particularly with regard to salary thresholds and qualifications:<\/p>\n<ul data-start=\"11123\" data-end=\"14966\">\n<li data-start=\"11123\" data-end=\"11724\">\n<p data-start=\"11125\" data-end=\"11724\"><em data-start=\"11125\" data-end=\"11161\">EU Blue Card for <strong data-start=\"11145\" data-end=\"11160\">Standard occupations<\/strong><\/em>, <strong data-start=\"11163\" data-end=\"11193\">\u00a7 Section 18g (1) sentence 1 AufenthG<\/strong> - The standard blue card for professions that do not fall under a special shortage definition. An employment contract is required with an annual gross salary of at least <strong data-start=\"11375\" data-end=\"11423\">50 % of the annual contribution assessment ceiling<\/strong> in the general pension insurance scheme (the exact salary limit is set annually, e.g. approx. \u224858,000 \u20ac per year, depending on the current assessment limit). In these cases, no approval from the Federal Employment Agency is required as long as there are no grounds for refusal in accordance with \u00a7 19f AufenthG.<\/p>\n<\/li>\n<li data-start=\"11725\" data-end=\"12312\">\n<p data-start=\"11727\" data-end=\"12312\"><em data-start=\"11727\" data-end=\"11764\">EU Blue Card for <strong data-start=\"11747\" data-end=\"11763\">Shortage occupations<\/strong><\/em>, <strong data-start=\"11766\" data-end=\"11802\">\u00a7 Section 18g (1) sentence 2 no. 1 AufenthG<\/strong> - For specialists who work in <strong data-start=\"11832\" data-end=\"11848\">Shortage occupations<\/strong> defined areas (e.g. doctors, engineers, IT specialists or other professions for which there is a particular need in Germany). Here, the salary threshold is reduced to <strong data-start=\"12038\" data-end=\"12077\">45.3 % of the contribution assessment ceiling<\/strong> (i.e. significantly lower than for standard occupations), <em data-start=\"12125\" data-end=\"12133\">however<\/em> approval from the Federal Employment Agency is required in these cases. The lower salary requirement is intended to facilitate recruitment in urgently needed professions.<\/p>\n<\/li>\n<li data-start=\"12313\" data-end=\"12792\">\n<p data-start=\"12315\" data-end=\"12792\"><em data-start=\"12315\" data-end=\"12354\">EU Blue Card for <strong data-start=\"12335\" data-end=\"12353\">Career starters<\/strong><\/em>, <strong data-start=\"12356\" data-end=\"12392\">\u00a7 Section 18g (1) sentence 2 no. 2 AufenthG<\/strong> - For foreign university graduates whose degree is <strong data-start=\"12457\" data-end=\"12500\">no longer than three years ago<\/strong>. The reduced salary threshold of 45.3 % of the contribution assessment ceiling also applies here (with the approval of the employment agency). This takes account of the fact that career starters often have a lower starting salary, but are nevertheless to be recruited as highly qualified specialists.<\/p>\n<\/li>\n<li data-start=\"12793\" data-end=\"13855\">\n<p data-start=\"12795\" data-end=\"13855\"><em data-start=\"12795\" data-end=\"12859\">EU Blue Card for <strong data-start=\"12815\" data-end=\"12858\">Graduates of tertiary education programmes<\/strong><\/em>, <strong data-start=\"12861\" data-end=\"12886\">\u00a7 Section 18g (2) AufenthG<\/strong> - This variant also enables an EU Blue Card for people who do not have a traditional university degree, but do have a <strong data-start=\"13012\" data-end=\"13057\">Equivalent tertiary education programme<\/strong> have successfully completed at least three years of training at level 6 of the European Qualifications Framework, e.g. a qualification equivalent to a Bachelor's degree from a vocational academy or a master craftsman\/technician qualification). In addition, in certain cases extensive <em data-start=\"13342\" data-end=\"13359\">Professional experience<\/em> can be taken into account instead of a formal qualification. For example, an IT specialist without a degree, but with several years of relevant professional experience and a salary above the specified threshold, can be issued an EU Blue Card. This opening up of the Blue Card reflects the extended requirements of the new EU directive and is intended to give talented specialists without a university degree a chance if their qualifications are practically equivalent to a university degree.<\/p>\n<\/li>\n<li data-start=\"13856\" data-end=\"14343\">\n<p data-start=\"13858\" data-end=\"14343\"><em data-start=\"13858\" data-end=\"13916\">Short-term mobility for holders of an EU Blue Card<\/em>, <strong data-start=\"13918\" data-end=\"13936\">\u00a7 Section 18h AufenthG<\/strong> - Holders of an EU Blue Card issued by another EU country are authorised to use the EU Blue Card for <strong data-start=\"14031\" data-end=\"14062\">Short stays up to 90 days<\/strong> come to Germany within 180 days and work here without having to apply for a German residence permit in advance (registration procedure is sufficient). This regulation facilitates business trips or project-related short stays by Blue Card holders within the EU.<\/p>\n<\/li>\n<li data-start=\"14344\" data-end=\"14966\">\n<p data-start=\"14346\" data-end=\"14966\"><em data-start=\"14346\" data-end=\"14404\">Long-term mobility for holders of an EU Blue Card<\/em>, <strong data-start=\"14406\" data-end=\"14424\">\u00a7 Section 18i AufenthG<\/strong> - For longer stays (over 90 days) by holders of an EU Blue Card issued in another EU country. In this case, the foreigner can obtain a German EU Blue Card if they wish to move to Germany for a longer period of time (e.g. change of employer within the EU). The requirements are based on the general criteria for the Blue Card, but applicants benefit from the fact that they are already Blue Card holders (e.g. the qualification is generally deemed to be proven if recognised in the other EU country).<\/p>\n<\/li>\n<\/ul>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"size-full wp-image-7064 aligncenter\" src=\"https:\/\/www.mth-partner.de\/wp-content\/uploads\/BlaueKarteEU.png\" alt=\"Types of EU Blue Card\" width=\"727\" height=\"547\" srcset=\"https:\/\/www.mth-partner.de\/wp-content\/uploads\/BlaueKarteEU.png 727w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/BlaueKarteEU-600x451.png 600w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/BlaueKarteEU-250x188.png 250w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/BlaueKarteEU-700x527.png 700w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/BlaueKarteEU-120x90.png 120w\" sizes=\"(max-width: 727px) 100vw, 727px\" \/><\/p>\n<p data-start=\"14968\" data-end=\"15271\"><strong data-start=\"14968\" data-end=\"15044\">Residence permit for intra-corporate transferees (ICT)<\/strong> - These titles serve to implement the EU ICT Directive 2014\/66\/EU. They make it easier for international companies to temporarily post employees to Germany. A distinction is made according to the duration and type of transfer:<\/p>\n<ul data-start=\"15273\" data-end=\"17119\">\n<li data-start=\"15273\" data-end=\"15728\">\n<p data-start=\"15275\" data-end=\"15728\"><em data-start=\"15275\" data-end=\"15286\">ICT card<\/em> for internally transferred <strong data-start=\"15324\" data-end=\"15360\">Managers or specialists<\/strong>, <strong data-start=\"15362\" data-end=\"15386\">\u00a7 Section 19 (2) AufenthG<\/strong> - A temporary residence permit issued to employees of an internationally active company who are travelling for a <strong data-start=\"15508\" data-end=\"15530\">Longer secondment<\/strong> (as a rule <strong data-start=\"15545\" data-end=\"15561\">over 90 days<\/strong>) to a German branch office. The prerequisite is an employment contract or secondment agreement with details of the manager\/specialist function.<\/p>\n<\/li>\n<li data-start=\"15729\" data-end=\"16006\">\n<p data-start=\"15731\" data-end=\"16006\"><em data-start=\"15731\" data-end=\"15755\">ICT card for trainees<\/em>, <strong data-start=\"15757\" data-end=\"15781\">\u00a7 Section 19 (3) AufenthG<\/strong> - Similar to the ICT card above, but specifically for <strong data-start=\"15833\" data-end=\"15858\">trainees\/interns<\/strong> in an internal exchange programme within the Group. It enables junior employees of a company to gain professional experience in Germany.<\/p>\n<\/li>\n<li data-start=\"16007\" data-end=\"16427\">\n<p data-start=\"16009\" data-end=\"16427\"><em data-start=\"16009\" data-end=\"16054\">Short-term mobility for ICT employees<\/em>, <strong data-start=\"16056\" data-end=\"16074\">\u00a7 Section 19a AufenthG<\/strong> - Holders of an ICT card issued in another EU country can use the <strong data-start=\"16158\" data-end=\"16185\">Short-term mobility<\/strong> work in Germany for up to 90 days in a 180-day period, <strong data-start=\"16253\" data-end=\"16261\">without<\/strong> to apply for a German residence permit (an official notification is also sufficient here).
