A bailiff has announced the date. And the tenant faces \u2013 for health, personal or family reasons \u2013 a situation that goes beyond what a forced eviction already entails.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For precisely these cases, the legislator has created a final instrument: the <\/span><b>Application for a stay of eviction under Section 765a of the Code of Civil Procedure<\/b><span style=\"font-weight: 400;\">. However, this application is not a simple deferral, nor is it an objection to the eviction order. It is a safety valve \u2013 and subject to strict conditions.<\/span><\/p>\n<p><b>Note:<\/b><span style=\"font-weight: 400;\"> This post is for general guidance only and does not constitute individual legal advice. By this point, the tenant has usually already exhausted all regular legal remedies \u2013 objection, appeal, eviction period under Section 721 of the German Code of Civil Procedure (ZPO).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">application for protection against eviction pursuant to Section 765a of the German Code of Civil Procedure (ZPO) is the <\/span><b>final remedy<\/b><span style=\"font-weight: 400;\">. It is not directed against the judgment itself, but against the specific enforcement measure \u2013 the impending eviction. And it only intervenes if, under the given circumstances, this eviction constitutes a <\/span><b>Unreasonable hardship<\/b><span style=\"font-weight: 400;\"> would represent.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Contra bonos mores \u2014 that sounds dramatic. And that's precisely what it is. Section 765a of the German Code of Civil Procedure (ZPO) is an exceptional provision. Courts interpret it restrictively, and the hurdles are deliberately high. This is because, on the other side, stands the landlord's constitutionally protected right to property (Article 14(1) of the German Basic Law) and their right to effective legal protection (Article 19(4) of the German Basic Law).<\/span><\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-5819\" src=\"https:\/\/www.mth-partner.de\/wp-content\/uploads\/Raeumungsschutzantrag.png\" alt=\"Application for eviction protection\" width=\"1920\" height=\"1080\" srcset=\"https:\/\/www.mth-partner.de\/wp-content\/uploads\/Raeumungsschutzantrag.png 1920w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/Raeumungsschutzantrag-600x338.png 600w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/Raeumungsschutzantrag-300x169.png 300w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/Raeumungsschutzantrag-1024x576.png 1024w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/Raeumungsschutzantrag-768x432.png 768w, https:\/\/www.mth-partner.de\/wp-content\/uploads\/Raeumungsschutzantrag-1536x864.png 1536w\" sizes=\"(max-width: 1920px) 100vw, 1920px\" \/><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Voraussetzungen_Wann_wird_Raumungsschutz_gewahrt\"><\/span><b>Prerequisites: When is eviction protection granted?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The court considers two questions for every application for protection against eviction:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Would the eviction lead to a <\/span><b>completely unbearable outcome<\/b><span style=\"font-weight: 400;\"> for the tenant?<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">On balance, and taking into account all the circumstances, do the tenant's interests outweigh the landlord's interest in enforcing their claim for possession?<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Only if both are affirmed is a temporary stay of enforcement possible.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Anerkannte_Grunde_fur_Raumungsschutz\"><\/span><b>Recognised grounds for eviction protection<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">What constitutes an immoral hardship always depends on the individual case. Over the years, however, case law has developed typical groups of cases:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Concrete risk of suicide<\/b><span style=\"font-weight: 400;\"> \u2014 the most common and, at the same time, legally most complex case. The court must examine whether there is a serious danger to life and whether this danger cannot be averted in another way (more on this below)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Serious illness<\/b><span style=\"font-weight: 400;\"> \u2014 if a move would demonstrably and significantly worsen the tenant's or a relative's health status. A mere assertion is not sufficient; a specific medical certificate referring to the eviction is required<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Pregnancy or recent childbirth<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Endangerment of child welfare<\/b><span style=\"font-weight: 400;\"> \u2014 if minor children were to find themselves in a concrete emergency situation as a result of the eviction<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Short-term impending move to a replacement apartment<\/b><span style=\"font-weight: 400;\"> \u2014 if the tenant can prove that they can move into a new flat within a few weeks<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Need for care<\/b><span style=\"font-weight: 400;\"> \u2014 if a severely ill dependent relative is being looked after in the flat and a transfer would be immediately dangerous to their health<\/span><\/li>\n<\/ul>\n<p><b>Not enough<\/b><span style=\"font-weight: 400;\"> against it: general economic difficulties, the strained housing market as such, a general burden on health without a specific connection to the eviction, or the desire to remain in familiar surroundings.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Die_Zwei-Wochen-Frist_Wann_muss_der_Antrag_gestellt_werden\"><\/span><b>The two-week deadline: When must the application be submitted?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The application for protection against eviction must be submitted <\/span><b>no later than two weeks before the scheduled eviction date<\/b><span style=\"font-weight: 400;\"> at the competent local court - the enforcement court (\u00a7 765a para. 3 ZPO). Caution: The day of the eviction appointment itself does not count.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">And here's a catch: if the last day of the deadline falls on a Saturday, Sunday or public holiday, the deadline is extended <\/span><b>not<\/b><span style=\"font-weight: 400;\"> until the next working day. The Federal Court of Justice has expressly decided this \u2013 the deadline is intended to protect the landlord, not the tenant.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Exceptions to the deadline exist only in two cases:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Die Gr\u00fcnde f\u00fcr den Antrag sind <\/span><b>only arose after expiry of the deadline<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The tenant was <\/span><b>through no fault of one's own<\/b><span style=\"font-weight: 400;\"> prevented from applying in good time<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Anyone who is late, without one of these exceptions applying, will have their application rejected for formal reasons alone \u2013 regardless of how serious the grounds may be.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Sonderfall_Suizidgefahr_Was_die_Rechtsprechung_verlangt\"><\/span><b>Special case risk of suicide: what case law requires<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Suicide risk is the most common and, at the same time, the most legally demanding reason for a protection from eviction application. The courts take these cases seriously \u2013 but they also have high requirements.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Drei_Prufungsschritte_des_Gerichts\"><\/span><b>Three court examination stages<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">From the case law of the BGH, a three-stage test can be derived:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Is there a concrete danger of suicide?<\/b><span style=\"font-weight: 400;\"> \u2014 The court must determine whether suicide can be reasonably expected. For this purpose, it usually obtains an expert opinion. Sweeping claims are not sufficient, but the Federal Court of Justice has also clarified that no excessive demands may be placed on the burden of proof (BGH V ZB 124\/10).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Can the danger be countered in other ways?<\/b><span style=\"font-weight: 400;\"> \u2014 For example, by involving the Ordnungsbeh\u00f6rden (regulatory authorities), the Betreuungsgericht (guardianship court), or through stationary crisis intervention. Only when all these alternatives are ruled out is a suspension of the eviction to be considered.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Do the tenant's interests prevail?<\/b><span style=\"font-weight: 400;\"> \u2014 The balancing of fundamental rights: protection of the tenant's life (Art. 2(2) of the Basic Law) against the landlord's guarantee of property (Art. 14 of the Basic Law). The court also considers whether the tenant himself contributes to eliminating the danger.<\/span><\/li>\n<\/ol>\n<h3><span class=\"ez-toc-section\" id=\"Mitwirkungspflicht_des_Mieters\"><\/span><b>Tenant's duty to cooperate<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">This last point is crucial \u2013 and often underestimated. The Federal Court of Justice (BGH) reiterated this in 2023 (Ref. I ZB 11\/23): The tenant can <\/span><b>every reasonable effort<\/b><span style=\"font-weight: 400;\"> to demand a reduction in health risk. Anyone who refuses an assessment, rejects offered therapy, or evades inpatient treatment must expect the court to deny eviction protection \u2013 even in cases of existing suicidal ideation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">And the Federal Constitutional Court (BVerfG) has also drawn the lines: In October 2024 (2 BvR 1308\/24), it rejected a constitutional complaint against the refusal of eviction protection. The courts had carefully weighed the interests \u2013 that is all the Basic Law requires.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Ein_BGH-Fall_aus_der_Praxis_I_ZB_1513_15052014\"><\/span><b>A BGH case from practice: I ZB 15\/13 (15.05.2014)<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">A case that the Federal Court of Justice monitored over several years shows how such a procedure can unfold in practice.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Der_Sachverhalt\"><\/span><b>The facts of the case<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">A tenant was ordered to vacate a property with a residential building. They applied for protection against eviction, citing a delusional disorder that would lead to suicide if the eviction were carried out. The local court initially rejected the application \u2013 the tenant had failed to attend a scheduled assessment.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Consequently, a legal guardian ad litem was appointed, as the tenant was partially incapacitated. A court-appointed expert was unable to examine the tenant in person \u2013 he refused to cooperate in any way. Nevertheless, the expert prepared an assessment based on the available documents: in the event of a forced eviction, suicide was probable.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The district court then ordered the eviction <\/span><i><span style=\"font-weight: 400;\">unlimited<\/span><\/i><span style=\"font-weight: 400;\"> in.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Die_Entscheidung_des_BGH\"><\/span><b>The BGH's decision<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">As a result, the BGH fundamentally upheld the dismissal \u2013 but corrected a crucial point: The <\/span><b>indefinite<\/b><span style=\"font-weight: 400;\"> Setting is not compatible with the landlord's property guarantee. The state's duty to protect the tenant's life cannot be resolved indefinitely by a prohibition of enforcement.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Instead, the setting must <\/span><b>limited and with conditions<\/b><span style=\"font-weight: 400;\"> to be provided \u2013 with the aim of improving the tenant's health. The tenant must be expected to work towards their recovery and prove the status of their treatment to the court. After the deadline has passed, the tenant must again demonstrate that the conditions for protection from eviction continue to exist.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The court specifically limited the suspension to three years.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Was_dieser_Fall_zeigt\"><\/span><b>What this case shows<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Three lessons from this judgment:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Risk of suicide can stop an eviction \u2013 but only temporarily, not permanently<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The court may use an expert report based on the case files if the tenant refuses a personal examination.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Even in cases of concrete danger to life, a fixed-term lease with a therapeutic condition must be granted \u2013 the tenant cannot permanently block enforcement.<\/span><\/li>\n<\/ol>\n<h2><span class=\"ez-toc-section\" id=\"Raumungsschutz_und_Hartefall-Widerspruch_Was_ist_der_Unterschied\"><\/span><b>Eviction protection and hardship objection: What is the difference?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The application for protection against eviction under Section 765a of the German Code of Civil Procedure (ZPO) is often confused with the objection to eviction on grounds of exceptional hardship under Section 574 of the German Civil Code (BGB). The application for protection against eviction is subsidiary\u2014it only applies when all other protection options have already been exhausted.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Was_muss_der_Raumungsschutzantrag_enthalten\"><\/span><b>What must the eviction protection application contain?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Case law does not place excessive formal demands on the content of an application. However, the more specific and well-supported the application is, the higher the chance of success.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">An effective eviction protection application should contain at least:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Designation of the eviction order<\/b><span style=\"font-weight: 400;\"> \u2014 Court, case number, date of judgment<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Notification of the set eviction date<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Explanation of the Grounds for Hardness<\/b><span style=\"font-weight: 400;\"> \u2014 concrete, with reference to the impending eviction<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Evidence<\/b><span style=\"font-weight: 400;\"> \u2014 Medical certificates, expert reports, proof of apartment search, employer or social welfare agency certificates<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Application for interim injunction<\/b><span style=\"font-weight: 400;\"> \u2014 until a decision is made on the main application<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">The application may be submitted in writing or registered in person at the registry of the local court. The local court within whose district the dwelling is located is responsible.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Haufig_gestellte_Fragen_zum_Raumungsschutzantrag\"><\/span><b>Frequently Asked Questions about the Eviction Protection Application<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3><span class=\"ez-toc-section\" id=\"Was_ist_ein_Raumungsschutzantrag_nach_%C2%A7_765a_ZPO\"><\/span><b>What is a stay of eviction application under \u00a7 765a ZPO?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">It is the last resort against an impending eviction. It can temporarily halt the eviction if carrying it out would constitute an unconscionable hardship\u2014for example, in cases of suicidal tendencies, serious illness, or pregnancy.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Bis_wann_muss_der_Antrag_gestellt_werden\"><\/span><b>By when must the application be submitted?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">At the latest two weeks before the eviction date (\u00a7 765a para. 3 ZPO). If the last day falls on a weekend, the deadline is not extended. Exceptions only apply in cases of subsequently arising reasons.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Welche_Grunde_werden_anerkannt\"><\/span><b>Which reasons are recognised?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Concrete suicide risk, serious illness with a risk of deterioration, pregnancy, endangering the welfare of a child, caring for a severely ill relative, impending move into accommodation. General financial difficulties or a tight housing market are not sufficient.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Reicht_ein_arztliches_Attest\"><\/span><b>Is a doctor's note sufficient?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">A medical certificate is important, but usually not sufficient on its own. The court will generally obtain an expert opinion. The medical certificate must specifically refer to the threatened eviction.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Wird_die_Raumung_durch_den_Antrag_automatisch_gestoppt\"><\/span><b>Does the eviction get stopped automatically if the application is made?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">No. But the court can order a temporary stay until the application is decided. Apply for both at the same time.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Kann_der_Raumungsschutz_unbefristet_gewahrt_werden\"><\/span><b>Can eviction protection be granted indefinitely?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">No. The Federal Court of Justice has ruled that an indefinite tenancy is incompatible with the landlord's property guarantee.
