{"id":5463,"date":"2025-11-29T11:59:08","date_gmt":"2025-11-29T11:59:08","guid":{"rendered":"https:\/\/www.mth-partner.de\/?p=5463"},"modified":"2025-12-09T09:19:09","modified_gmt":"2025-12-09T09:19:09","slug":"auslaenderrecht-aufenthaltserlaubnis-wegen-nachhaltiger-integration-ist-bei-vereitelung-der-ausreise-zu-versagen","status":"publish","type":"post","link":"https:\/\/www.mth-partner.de\/en\/foreigners-law-a-residence-permit-due-to-sustainable-integration-must-be-denied-if-there-is-an-obstruction-of-departure\/","title":{"rendered":"Foreigners Law: A residence permit due to sustainable integration must be denied if there is an obstruction of departure."},"content":{"rendered":"<p><strong>Higher Administrative Court of Baden-W\u00fcrttemberg, Decision from April 9, 2019, Case No.: 11 S 2868\/18<\/strong><\/p>\n<p data-start=\"221\" data-end=\"672\">Section 25b of the Residence Act (AufenthG) gives people who have been in Germany for a long time with a tolerated stay permit, temporary residence permit or residence authorisation the opportunity to obtain a residence permit under certain conditions. The aim of the regulation is to reward people who, despite their uncertain residence status <strong data-start=\"581\" data-end=\"665\">sustainably integrated into German social and living conditions<\/strong> have.<\/p>\n<p data-start=\"674\" data-end=\"816\">According to the current legal situation, the granting of a residence permit in accordance with Section 25b AufenthG requires the following conditions in particular:<\/p>\n<ul data-start=\"818\" data-end=\"1930\">\n<li data-start=\"818\" data-end=\"1165\">\n<p data-start=\"820\" data-end=\"1165\"><strong data-start=\"820\" data-end=\"848\">Minimum length of stay:<\/strong> The foreigner must have <strong data-start=\"878\" data-end=\"905\">at least six years<\/strong> are continuously tolerated, authorised or have a residence permit in Germany.<br data-start=\"1003\" data-end=\"1006\" \/>If the person lives with a <strong data-start=\"1034\" data-end=\"1066\">underage, unmarried child<\/strong> in a domestic partnership, the required period of prior residence is reduced to <strong data-start=\"1150\" data-end=\"1164\">four years<\/strong>.<\/p>\n<\/li>\n<li data-start=\"1167\" data-end=\"1340\">\n<p data-start=\"1169\" data-end=\"1340\"><strong data-start=\"1169\" data-end=\"1230\">Commitment to the free democratic basic order<\/strong> and <strong data-start=\"1237\" data-end=\"1293\">Basic knowledge of the legal and social order<\/strong> and the <strong data-start=\"1302\" data-end=\"1339\">Living conditions in Germany<\/strong>.<\/p>\n<\/li>\n<li data-start=\"1342\" data-end=\"1653\">\n<p data-start=\"1344\" data-end=\"1653\"><strong data-start=\"1344\" data-end=\"1379\">Securing a livelihood:<\/strong> The livelihood should <strong data-start=\"1405\" data-end=\"1443\">predominantly through gainful employment<\/strong> or it must be secured due to school, training, income or family situation. <strong data-start=\"1542\" data-end=\"1569\">Realistically to be expected<\/strong> be that this will succeed in the future.<br data-start=\"1605\" data-end=\"1608\" \/>The purchase of <strong data-start=\"1624\" data-end=\"1636\">Housing benefit<\/strong> is harmless.<\/p>\n<\/li>\n<li data-start=\"1655\" data-end=\"1831\">\n<p data-start=\"1657\" data-end=\"1831\"><strong data-start=\"1657\" data-end=\"1679\">German language skills:<\/strong> The person must have <strong data-start=\"1701\" data-end=\"1763\">Sufficient oral German language skills at level A2<\/strong> of the Common European Framework of Reference for Languages.<\/p>\n<\/li>\n<li data-start=\"1833\" data-end=\"1930\">\n<p data-start=\"1835\" data-end=\"1930\"><strong data-start=\"1835\" data-end=\"1868\">For school-age children:<\/strong> It must be the <strong data-start=\"1881\" data-end=\"1909\">Actual school attendance<\/strong> can be proven.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1932\" data-end=\"2162\">These requirements form the basis for the further process of granting residence and are intended to ensure that people who have been living in Germany for years are given genuine prospects of integration.<\/p>\n<p>Even if these requirements are met, the granting of a residence permit must be denied if the foreigner has prevented or delayed the termination of their stay by intentionally providing false information, by deception regarding their identity or nationality, or by failing to fulfill reasonable requirements for cooperation in the removal of obstacles to departure.<\/p>\n<p>In the case discussed here, the foreigner\u2019s application for a residence permit under Section 25b AufenthG was denied because the immigration authority assumed that the applicant from Cameroon had not done everything reasonably possible to eliminate the obstacle to departure, which was the lack of a return document. The Administrative Court initially agreed with this view and dismissed the applicant\u2019s lawsuit. The applicant then appealed to the Higher Administrative Court of Baden-W\u00fcrttemberg.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Einleitung_Ablehnung_der_Berufung\"><\/span>Introduction: Rejection of the Appeal<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Higher Administrative Court of Baden-W\u00fcrttemberg (VGH) ruled that the application for the appeal was admissible but unfounded. The appeal was not allowed due to serious doubts about the correctness of the judgment under Section 124 (2) No. 1 of the Administrative Court Procedures Act (VwGO). Serious doubts exist when the correctness of the contested judgment requires further examination based on the points raised by the applicant, and the appeal appears likely to succeed. The purpose of the admission procedure is not to preempt the appeal process but to ensure that the administrative court has correctly decided the case.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Substantiierungserfordernisse_im_Zulassungsverfahren\"><\/span>Substantiation Requirements in the Admission Procedure<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The applicant must substantiate why there are serious doubts. A case-specific justification is required, allowing the appeal court to assess the admission question without extensive investigations. The level of substantiation depends on the detail of the reasoning in the challenged decision. In the present case, the applicant did not demonstrate serious doubts about the correctness of the contested judgment.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Prufung_der_Mitwirkungspflichten_des_Klagers\"><\/span>Examination of the Applicant\u2019s Cooperation Obligations<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The applicant argued that the administrative court wrongly assumed the denial ground under Section 25b (2) No. 1 AufenthG, as he had no influence over the non-issuance of a passport by the Cameroonian embassy. However, the court found that the applicant failed to demonstrate that he had made sufficient and reasonable efforts to obtain a passport. The passport obligation under Section 3 (1) AufenthG is a regular requirement, and the applicant is required to take all necessary measures to fulfill their obligation to leave the country. Doubts about the possibility of obtaining a passport are the applicant\u2019s responsibility.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Versagungsnorm_und_Beweislast\"><\/span>Denial Norm and Burden of Proof<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Section 25b (2) No. 1 AufenthG ties into the cooperation obligations of the foreigner that fall within their sphere of influence. The foreigner must prove that they have fulfilled these obligations in a reasonable manner. Only when these obligations are met does the immigration authority bear the burden of proof that further cooperation measures are necessary. In the applicant\u2019s case, there was no comprehensible explanation of his efforts to obtain a passport since 2014.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Integrationserfordernisse_des_%C2%A7_25b_AufenthG\"><\/span>Integration Requirements of Section 25b AufenthG<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The VGH found that the applicant did not meet the requirements for sustainable integration under Section 25b AufenthG. In particular, he has not secured his livelihood independently for many years. The fact that his employment was prohibited due to unmet cooperation obligations also falls under his responsibility. Even if the applicant does not fulfill the exclusion criterion of Section 25b (2) No. 1 3rd alternative AufenthG, his previous behavior in passport procurement is to be negatively considered.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Schlussfolgerung_Keine_gelungene_Integration\"><\/span>Conclusion: No Successful Integration<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Senate could not see any successful integration of the applicant. Given the applicant\u2019s behavior in obtaining a passport and the failure to meet the integration requirements under Section 25b AufenthG, the appeal was not to be allowed.
