But which residence permit is suitable, what are the requirements, and how high does the salary need to be? Since the reformed Skilled Immigration Act (FEG) came into force in three stages between November 2023 and June 2024, much has improved \u2013 but also become more complicated.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This article explains the two central residence permits for skilled workers from non-EU countries: <\/span><b>Section 18a AufenthG:<\/b><span style=\"font-weight: 400;\"> (Vocational training) and <\/span><b>Section 18b AufenthG:<\/b><span style=\"font-weight: 400;\"> (academic education). Furthermore: the EU Blue Card, the recognition partnership, and the pathway to <\/span><a href=\"https:\/\/www.mth-partner.de\/en\/category\/auslaenderrecht-anwalt\/niederlassungserlaubnis\/\"><span style=\"font-weight: 400;\">Settlement permit<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><b>Note:<\/b><span style=\"font-weight: 400;\"> This post is for general guidance only and does not replace individual legal advice. This meant: the foreigners' authority had discretionary power. It could refuse, even if all the requirements were met.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This has fundamentally changed. Since 18 November 2023, it is: The residence permit <\/span><i><span style=\"font-weight: 400;\">becomes<\/span><\/i><span style=\"font-weight: 400;\"> granted. Anyone who meets the requirements now has a <\/span><b>Legal claim<\/b><span style=\"font-weight: 400;\">. There is no longer any discretion \u2013 the authority must grant the title.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">And a second change is almost as important: the old tie to one's learned profession has disappeared. Previously, a trained engineer also had to work as an engineer. Today, skilled workers are allowed to <\/span><b>every qualified employment<\/b><span style=\"font-weight: 400;\"> practise \u2013 regardless of what they originally trained as. An exception only applies to regulated professions (doctors, lawyers, etc.) where a professional practising licence is required.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"%C2%A7_18a_AufenthG_%E2%80%94_Fachkrafte_mit_Berufsausbildung\"><\/span><b>\u00a7 18a Residence Act \u2014 Skilled workers with vocational training<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3><span class=\"ez-toc-section\" id=\"Wer_gilt_als_Fachkraft_mit_Berufsausbildung\"><\/span><b>Who is considered a skilled worker with vocational training?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">A skilled worker with vocational training is, according to \u00a7 18 (3) No. 1 of the Residence Act, any person from a third country who possesses a <\/span><b>Vocational training<\/b><span style=\"font-weight: 400;\"> has completed at least two years of vocational training. This can be German vocational training \u2013 or foreign vocational training that has been recognised as equivalent.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Prerequisite: The training must have been completed in a state-recognised or comparably regulated vocational occupation. An overview of recognised vocational occupations can be found at the Federal Institute for Vocational Training (BIBB) at <\/span><a href=\"https:\/\/www.bibb.de\/dienst\/publikationen\/de\/19128\"><span style=\"font-weight: 400;\">bibb.de<\/span><\/a><span style=\"font-weight: 400;\">. The portal checks whether your foreign degree is eligible for recognition. <\/span><a href=\"https:\/\/www.anerkennung-in-deutschland.de\/\"><span style=\"font-weight: 400;\">recognition-in-germany.de<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Voraussetzungen_im_Uberblick\"><\/span><b>Overview of Requirements<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Recognised professional qualification<\/b><span style=\"font-weight: 400;\"> either a German vocational training qualification or a foreign qualification recognised as equivalent<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Concrete job offer<\/b><span style=\"font-weight: 400;\"> for qualified employment (since 2024: in any subject area, not just in the trained profession)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Approval from the Federal Employment Agency<\/b><span style=\"font-weight: 400;\"> \u2014 the Federal Employment Agency checks whether the employment conditions (salary, working hours) meet German standards. A priority check has not taken place since 2020<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Secure livelihood<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Valid passport<\/b><span style=\"font-weight: 400;\"> and clarified identity<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>No intention of deportation<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Professional practice permit<\/b><span style=\"font-weight: 400;\"> \u2013 if required (e.g. for healthcare professions)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Special rule for over 45s:<\/b><span style=\"font-weight: 400;\"> Upon initial issuance after reaching the age of 45, the gross annual salary must be at least <\/span><b>55,770 euros<\/b><span style=\"font-weight: 400;\"> (2026) shall be \u20ac23,000 or provide proof of an adequate pension<\/span><\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"%C2%A7_18b_AufenthG_%E2%80%94_Fachkrafte_mit_akademischer_Ausbildung\"><\/span><b>\u00a7 18b German Residence Act - Academically Qualified Professionals<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3><span class=\"ez-toc-section\" id=\"Wer_gilt_als_Fachkraft_mit_akademischer_Ausbildung\"><\/span><b>Wer gilt als Fachkraft mit akademischer Ausbildung?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">A qualified professional with academic training, according to \u00a7 18 (3) No. 2 of the Residence Act (AufenthG), is any person with a <\/span><b>German, recognised foreign or comparable university degree<\/b><span style=\"font-weight: 400;\">. Whether a foreign degree is recognised can be determined via the <\/span><a href=\"https:\/\/anabin.kmk.org\/\"><span style=\"font-weight: 400;\">Anabin database<\/span><\/a><span style=\"font-weight: 400;\"> to the KMK check.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Unlike vocational training, a formal recognition procedure is generally not required \u2013 comparability is sufficient. And here too, since November 2023: Specialists with a university degree are allowed to take up any qualified employment, not just those corresponding to their studies.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Voraussetzungen\"><\/span><b>Prerequisites<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Essentially, the same requirements apply as in Section 18a \u2013 with the difference that a university degree must be present instead of vocational training. Since November 2023, there have been four variants:<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"1_Normale_Blaue_Karte_%C2%A7_18g_Abs_1_S_1\"><\/span><b>1. Here, the Federal Employment Agency merely checks whether the employment conditions (salary, working hours) correspond to the usual standards and whether financial subsistence is secured within the meaning of SGB II.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Ablauf_und_Dokumente_Vom_Jobangebot_zum_Aufenthaltstitel\"><\/span><b>Process and Documents: From Job Offer to Residence Permit<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Those wishing to come to Germany as a skilled worker typically go through five steps. The exact order depends on whether the regular or the accelerated procedure is chosen \u2013 but the basic structure is always the same:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Secure job offer<\/b><span style=\"font-weight: 400;\"> You need a concrete job offer from a German employer for a qualified position. No visa without a job offer (exception: Chancenkarte for job searching).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Recognise qualifications<\/b><span style=\"font-weight: 400;\"> \u2014 For vocational training: Recognition of equivalence via the responsible body (depending on the profession, the Chamber of Industry and Commerce, Chamber of Crafts or specialist authority). For university degrees: Check comparability via <\/span><a href=\"https:\/\/anabin.kmk.org\/\"><span style=\"font-weight: 400;\">Anabin<\/span><\/a><span style=\"font-weight: 400;\"> or ZAB certificate assessment. For regulated professions (e.g. doctors, nurses): additionally apply for the professional practice permit<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Apply for a visa<\/b><span style=\"font-weight: 400;\"> \u2014 at the German mission abroad in the country of origin.
