{"id":6548,"date":"2025-11-29T14:51:59","date_gmt":"2025-11-29T14:51:59","guid":{"rendered":"https:\/\/www.mth-partner.de\/?p=6548"},"modified":"2025-12-19T10:37:35","modified_gmt":"2025-12-19T10:37:35","slug":"die-niederlassungserlaubnis-fuer-fachkraefte-und-inhaber-der-blauen-karte-eu","status":"publish","type":"post","link":"https:\/\/www.mth-partner.de\/en\/the-residence-permit-for-skilled-workers-and-holders-of-the-eu-blue-card\/","title":{"rendered":"The settlement permit for skilled workers and EU Blue Card holders"},"content":{"rendered":"<p data-start=\"86\" data-end=\"876\">With the new law that came into force in March 2020 <strong data-start=\"127\" data-end=\"160\">Skilled Labour Immigration Act<\/strong> and the implementation in November 2023 of the requirements of the <strong data-start=\"223\" data-end=\"252\">Directive (EU) 2021\/1883<\/strong> (Blue Card Directive), the legislator has created numerous new regulations with regard to labour migration. One of the most important innovations is the <strong data-start=\"407\" data-end=\"469\">Settlement permit for skilled workers according to \u00a7 18c AufenthG<\/strong>, which enables qualified foreign workers to obtain an unlimited residence permit (permanent residence) in Germany under simplified conditions. The following describes who can be recognised as <em data-start=\"725\" data-end=\"736\">Specialist<\/em> applies and which current requirements (legal status November 2025) must be met for this settlement permit to be issued.<\/p>\n<h2 data-start=\"878\" data-end=\"906\"><span class=\"ez-toc-section\" id=\"Wer_gilt_als_%E2%80%9EFachkraft%E2%80%9C\"><\/span>Who is considered a \u201eskilled worker\u201c?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"908\" data-end=\"1053\">As <em data-start=\"912\" data-end=\"923\">Specialist<\/em> According to the law, the following persons with qualified training or employment are considered to be \"qualified persons\" within the meaning of the Residence Act:<\/p>\n<ul data-start=\"1055\" data-end=\"1868\">\n<li data-start=\"1055\" data-end=\"1263\">\n<p data-start=\"1057\" data-end=\"1263\"><strong data-start=\"1057\" data-end=\"1092\">Specialists with vocational training<\/strong> - Persons with a professional qualification recognised in Germany or a foreign professional qualification recognised as equivalent (legal basis: \u00a7 18a AufenthG).<\/p>\n<\/li>\n<li data-start=\"1264\" data-end=\"1490\">\n<p data-start=\"1266\" data-end=\"1490\"><strong data-start=\"1266\" data-end=\"1308\">Specialists with an academic education<\/strong> - Persons with a German university degree, a recognised foreign university degree or an equivalent qualification (legal basis: \u00a7 18b AufenthG).<\/p>\n<\/li>\n<li data-start=\"1491\" data-end=\"1657\">\n<p data-start=\"1493\" data-end=\"1657\"><strong data-start=\"1493\" data-end=\"1505\">Researchers<\/strong> - Foreigners who are working in Germany for research purposes and hold a corresponding residence permit (legal basis: Section 18d AufenthG).<\/p>\n<\/li>\n<li data-start=\"1658\" data-end=\"1868\">\n<p data-start=\"1660\" data-end=\"1868\"><strong data-start=\"1660\" data-end=\"1691\">Holders of the EU Blue Card<\/strong> - Highly qualified persons with a university degree (or comparable qualification) and a higher income who are in possession of an EU Blue Card (legal basis: \u00a7 18g AufenthG).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1870\" data-end=\"2122\">These four categories of residence permits are the basis for the <strong data-start=\"1935\" data-end=\"1954\">Specialist status<\/strong>. Various simplified immigration options were created on this basis - including the settlement permit for skilled workers in accordance with Section 18c AufenthG.<\/p>\n<h2 data-start=\"2124\" data-end=\"2189\"><span class=\"ez-toc-section\" id=\"Niederlassungserlaubnis_fur_Fachkrafte_%C2%A7%E2%80%AF18c_Abs_1_AufenthG\"><\/span>Settlement permit for skilled workers (Section 18c (1) AufenthG)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"2191\" data-end=\"2979\">Specialists who are in possession of one of the above-mentioned <strong data-start=\"2242\" data-end=\"2293\">Residence permit for the purpose of gainful employment<\/strong> (Sections 18a, 18b, 18d or 18g AufenthG) may, in accordance with Section 18c (1) AufenthG, under certain conditions <strong data-start=\"2389\" data-end=\"2423\">privileged conditions<\/strong> apply for a settlement permit (permanent residence permit). These privileged conditions deliberately deviate from the general requirements of \u00a7 9 AufenthG (which, for example, generally require 5 years of prior residence and 60 months of pension contributions) in order to enable qualified workers to change status more quickly. The settlement permit is an unlimited residence title and authorises unrestricted gainful employment in Germany.<\/p>\n<p data-start=\"2981\" data-end=\"3219\"><strong data-start=\"2981\" data-end=\"3001\">Prerequisites:<\/strong> A skilled worker can obtain a settlement permit in accordance with Section 18c (1) AufenthG, <strong data-start=\"3087\" data-end=\"3106\">if they <em data-start=\"3098\" data-end=\"3104\">all<\/em><\/strong> of the following conditions are met:<\/p>\n<ul data-start=\"3221\" data-end=\"5898\">\n<li data-start=\"3221\" data-end=\"3577\">\n<p data-start=\"3223\" data-end=\"3577\"><strong data-start=\"3223\" data-end=\"3252\">Duration of the previous stay:<\/strong> The specialist has been <em data-start=\"3276\" data-end=\"3300\">at least three years<\/em> in possession of a qualified residence permit in accordance with \u00a7 18a, \u00a7 18b, \u00a7 18d or \u00a7 18g AufenthG. (This period was shortened from 4 years to 3 years by the legislative reforms in 2023\/24).<\/p>\n<\/li>\n<li data-start=\"3578\" data-end=\"3994\">\n<p data-start=\"3580\" data-end=\"3994\"><strong data-start=\"3580\" data-end=\"3621\">Qualification-adequate employment:<\/strong> She is in employment (job) that corresponds to her qualifications and which she is authorised to occupy in accordance with the requirements of Sections 18a, 18b, 18d or 18g AufenthG. This means that the current job must be suitable for the skilled worker status she has acquired and any necessary professional licences have been obtained.<\/p>\n<\/li>\n<li data-start=\"3995\" data-end=\"4509\">\n<p data-start=\"3997\" data-end=\"4509\"><strong data-start=\"3997\" data-end=\"4029\">Pension insurance contributions:<\/strong> She has <em data-start=\"4038\" data-end=\"4060\">at least 36 months<\/em> Compulsory or voluntary contributions paid into the German statutory pension insurance scheme <strong data-start=\"4158\" data-end=\"4166\">or<\/strong> can provide evidence of expenses for an entitlement to comparable benefits from a pension or insurance institution. (This requirement has also been lowered compared to the previous 48 months. In comparison, a regular settlement permit in accordance with \u00a7 9 AufenthG usually requires 60 months of contributions).<\/p>\n<\/li>\n<li data-start=\"4510\" data-end=\"4839\">\n<p data-start=\"4512\" data-end=\"4839\"><strong data-start=\"4512\" data-end=\"4534\">German language skills:<\/strong> The specialist has <em data-start=\"4562\" data-end=\"4609\">sufficient knowledge of the German language<\/em>, which in practice corresponds to the <strong data-start=\"4670\" data-end=\"4683\">Level B1<\/strong> of the Common European Framework of Reference for Languages. A B1 language certificate (e.g. from the Goethe-Institut or TELC) regularly serves as proof.<\/p>\n<\/li>\n<li data-start=\"4840\" data-end=\"5898\">\n<p data-start=\"4842\" data-end=\"5898\"><strong data-start=\"4842\" data-end=\"4876\">Further integration criteria:<\/strong> The <strong data-start=\"4881\" data-end=\"4912\">General requirements<\/strong> of \u00a7 9 para. 2 sentence 1 <strong data-start=\"4935\" data-end=\"4967\">No. 2, 4-6, 8 and 9 AufenthG<\/strong> must be present. This includes the following points in particular, which <em data-start=\"5083\" data-end=\"5110\">for all permanent stays<\/em> apply: The applicant must have a valid <strong data-start=\"5173\" data-end=\"5204\">secure livelihood<\/strong> (i.e. be able to earn a living without social benefits), it must be <strong data-start=\"5287\" data-end=\"5347\">No danger to public safety or order<\/strong> he\/she must not commit any serious criminal offences or extremist activities, he\/she must <strong data-start=\"5439\" data-end=\"5505\">Basic knowledge of the German legal and social order<\/strong> (usually proven by the naturalisation test or orientation course certificate) and have <strong data-start=\"5614\" data-end=\"5640\">sufficient living space<\/strong> for themselves and, if applicable, their family. <em data-start=\"5720\" data-end=\"5731\">(Note:<\/em> Certain of these requirements - such as a work permit - are usually already met by skilled workers with a valid work visa)*.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"5900\" data-end=\"6616\">When <em data-start=\"5905\" data-end=\"5911\">all<\/em> the above criteria are met, there is a <strong data-start=\"5955\" data-end=\"5973\">Legal claim<\/strong> for the issue of a settlement permit for skilled workers in accordance with Section 18c (1) AufenthG (the immigration authority must therefore issue it). <strong data-start=\"6105\" data-end=\"6117\">Important:<\/strong> For skilled workers who have obtained their qualification in Germany, the following apply <em data-start=\"6192\" data-end=\"6227\">Conditions eased once again<\/em>. If the specialist has a <strong data-start=\"6251\" data-end=\"6340\">successfully completed a degree programme or vocational training in Germany<\/strong>, the required pre-stay period is reduced to <em data-start=\"6397\" data-end=\"6409\">two years<\/em> and the required pension contribution period to <em data-start=\"6455\" data-end=\"6466\">24 months<\/em>. The aim is to ensure that talented people trained in Germany are more quickly and permanently retained in the labour market.<\/p>\n<h2 data-start=\"6618\" data-end=\"6700\"><span class=\"ez-toc-section\" id=\"Niederlassungserlaubnis_fur_Inhaber_der_Blauen_Karte_EU_%C2%A7%E2%80%AF18c_Abs_2_AufenthG\"><\/span>Settlement permit for holders of the EU Blue Card (Section 18c (2) AufenthG)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"6702\" data-end=\"7021\">For holders of a <strong data-start=\"6720\" data-end=\"6739\">EU Blue Card<\/strong> special privileges apply once again when granting a settlement permit. The EU Blue Card is aimed at highly qualified skilled workers with an academic degree and above-average salary, and it opens up faster access to permanent residence.<\/p>\n<p data-start=\"7023\" data-end=\"7194\">Pursuant to Section 18c (2) AufenthG, a foreigner who holds an EU Blue Card must be granted a settlement permit if they fulfil the following requirements:<\/p>\n<ul data-start=\"7196\" data-end=\"7648\">\n<li data-start=\"7196\" data-end=\"7532\">\n<p data-start=\"7198\" data-end=\"7532\">He has <strong data-start=\"7205\" data-end=\"7235\">for at least 27 months<\/strong> exercised employment pursuant to Section 18g AufenthG (EU Blue Card) and paid pension insurance contributions during this period. (This period was also reduced in 2023 - previously 33 months were required).<\/p>\n<\/li>\n<li data-start=\"7533\" data-end=\"7648\">\n<p data-start=\"7535\" data-end=\"7648\">It has <strong data-start=\"7551\" data-end=\"7581\">basic knowledge of German<\/strong>, accordingly <em data-start=\"7596\" data-end=\"7607\">Level A1.<\/em><\/p>\n<\/li>\n<\/ul>\n<blockquote data-start=\"7650\" data-end=\"8039\">\n<p data-start=\"7651\" data-end=\"8039\"><em data-start=\"7651\" data-end=\"7695\">Shortening with better language skills:<\/em> If the Blue Card holder has <strong data-start=\"7731\" data-end=\"7773\">sufficient German language skills<\/strong> (level B1), the required period of employment is reduced from 27 months to <strong data-start=\"7858\" data-end=\"7871\">21 months<\/strong>. This means that well-integrated Blue Card holders can obtain permanent residence after just one and a half years*.<\/p>\n<\/blockquote>\n<p data-start=\"8041\" data-end=\"8911\">In addition, the foreigner must - as with the skilled worker settlement permit - fulfil the general requirements, in particular <strong data-start=\"8186\" data-end=\"8219\">the livelihood is secured<\/strong> be, it may <strong data-start=\"8236\" data-end=\"8299\">No threats to public safety or order<\/strong> be present, it must <strong data-start=\"8319\" data-end=\"8385\">Basic knowledge of the German legal and social order<\/strong> and <strong data-start=\"8401\" data-end=\"8427\">sufficient living space<\/strong> for themselves and, if applicable, their family members. These criteria correspond to the above-mentioned requirements from Section 9 AufenthG and are also assumed in the Blue Card case. In practice, Blue Card holders are usually already in a position to fulfil these points due to their employment and income (high salary \u2192 secure livelihood; often academic integration \u2192 basic knowledge of society).<\/p>\n<p data-start=\"8913\" data-end=\"9257\"><strong data-start=\"8913\" data-end=\"8925\">Note:<\/strong> The periods mentioned (27 or 21 months) only apply to holders of the <strong data-start=\"8995\" data-end=\"9008\">German<\/strong> EU Blue Card. Periods spent in other EU countries with a Blue Card can be <em data-start=\"9105\" data-end=\"9112\">not<\/em> be counted towards these 27\/21 months, but may be useful for acquiring the EU permanent right of residence (topic <em data-start=\"9234\" data-end=\"9254\">Permanent residence-EU<\/em>).<\/p>\n<h2 data-start=\"9259\" data-end=\"9351\"><span class=\"ez-toc-section\" id=\"Besonderheiten_fur_Absolventen_und_hochqualifizierte_Fachkrafte_%C2%A7%E2%80%AF18c_Abs_1_und_Abs_3\"><\/span>Special features for graduates and highly qualified specialists (Section 18c (1) and (3))<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"9353\" data-end=\"10010\"><strong data-start=\"9353\" data-end=\"9390\">Shorter times for graduates:<\/strong> As mentioned above, foreign companies benefit from <strong data-start=\"9442\" data-end=\"9503\">Graduates of German universities or vocational training programmes<\/strong> Shortened waiting times. If a skilled worker has completed their studies or training in Germany, it is sufficient to <em data-start=\"9627\" data-end=\"9639\">two years<\/em> Possession of a skilled worker residence permit (instead of 3 years) and <em data-start=\"9705\" data-end=\"9716\">24 months<\/em> Pension contributions (instead of 36 months) for the settlement permit. This concession is intended to make it easier for talented individuals educated in Germany to remain in Germany and is in addition to the other requirements (language skills, living expenses, etc.).<\/p>\n<p data-start=\"10012\" data-end=\"10951\"><strong data-start=\"10012\" data-end=\"10060\">Highly qualified skilled workers (Section 18c (3)):<\/strong> For <em data-start=\"10065\" data-end=\"10094\">particularly highly qualified<\/em> The law provides a further exception for skilled workers with an academic qualification. According to \u00a7 18c Para. 3 AufenthG <em data-start=\"10207\" data-end=\"10213\">shall<\/em> A highly qualified skilled worker may even be granted a permanent residence permit in special cases, <strong data-start=\"10326\" data-end=\"10393\">if not all of the above conditions are met<\/strong>. However, this \u201cfast-track\u201d regulation only comes into effect under strict conditions: in particular <strong data-start=\"10495\" data-end=\"10589\">integration into German living conditions is likely to succeed without problems<\/strong> and <strong data-start=\"10594\" data-end=\"10638\">the livelihood is sustainably secured<\/strong> so that no state aid is required. In addition, it goes without saying that <em data-start=\"10760\" data-end=\"10767\">none<\/em> the person poses a threat to public safety - the <strong data-start=\"10837\" data-end=\"10862\">Forecast must be positive<\/strong> be that the person will be able to cope economically and socially in Germany.<\/p>\n<p data-start=\"10953\" data-end=\"11617\">In such exceptional cases, the settlement permit will be <strong data-start=\"11012\" data-end=\"11060\">without the consent of the Federal Employment Agency<\/strong> (Section 18c (3) sentence 1 AufenthG), which is otherwise often required for work stays. However, the respective <strong data-start=\"11185\" data-end=\"11204\">State government<\/strong> stipulate that the approval of the highest state authority must be obtained before the permit is issued (Section 18c (3) sentence 2 AufenthG). The hurdles for this exception are high, but it theoretically offers top researchers, for example, the opportunity to obtain a settlement permit even without fully meeting all the standard criteria.<\/p>\n<p data-start=\"11619\" data-end=\"12252\">As <strong data-start=\"11623\" data-end=\"11655\">Highly qualified specialists<\/strong> within the meaning of Section 18c (3) are deemed by law to be <em data-start=\"11701\" data-end=\"11717\">for example<\/em> Scientists with <strong data-start=\"11738\" data-end=\"11775\">Specialised technical knowledge<\/strong> as well as teachers or research assistants in <strong data-start=\"11833\" data-end=\"11863\">prominent functions<\/strong>. This list is not exhaustive, but makes it clear that these must be people with exceptional qualifications and several years of professional experience.
