{"id":6577,"date":"2026-01-03T12:08:25","date_gmt":"2026-01-03T12:08:25","guid":{"rendered":"https:\/\/www.mth-partner.de\/?p=6577"},"modified":"2026-03-04T09:44:15","modified_gmt":"2026-03-04T09:44:15","slug":"einbuergerung-5-stag-erwerb-der-deutschen-staatsangehoerigkeit-durch-erklaerung","status":"publish","type":"post","link":"https:\/\/www.mth-partner.de\/en\/naturalisation-5-day-acquisition-of-german-citizenship-by-declaration\/","title":{"rendered":"Naturalisation: \u00a7 5 StAG Acquisition of German citizenship by declaration"},"content":{"rendered":"<p>Persons born after the Basic Law came into force, i.e. after 23 May 1949, have been able to acquire German citizenship by declaration in accordance with Section 5 StAG since 20 August 2021.<\/p>\n<p>This means that people should now also have the opportunity to acquire the <a href=\"https:\/\/www.mth-partner.de\/en\/german-citizenship-by-descent\/\">be given German citizenship<\/a>, who had previously been denied a birth certificate due to gender discrimination in nationality law.<\/p>\n<h2 data-start=\"1212\" data-end=\"1242\"><span class=\"ez-toc-section\" id=\"Das_Wichtigste_in_12_Zeilen\"><\/span>The most important facts in 12 lines<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ul data-start=\"1244\" data-end=\"2797\">\n<li data-start=\"1244\" data-end=\"1311\">\n<p data-start=\"1246\" data-end=\"1311\">The acquisition of a declaration in accordance with \u00a7 5 StAG has existed since <strong data-start=\"1294\" data-end=\"1308\">20.08.2021<\/strong>.<\/p>\n<\/li>\n<li data-start=\"1312\" data-end=\"1389\">\n<p data-start=\"1314\" data-end=\"1389\">Only persons who <strong data-start=\"1348\" data-end=\"1371\">after 23 May 1949<\/strong> were born.<\/p>\n<\/li>\n<li data-start=\"1390\" data-end=\"1582\">\n<p data-start=\"1392\" data-end=\"1582\">There are <strong data-start=\"1400\" data-end=\"1420\">four case groups<\/strong>(1) Child of a German parent without acquisition by birth, (2) Child of a mother with loss of marriage before birth, (3) Loss through legitimisation, (4) Descendants.<\/p>\n<\/li>\n<li data-start=\"1583\" data-end=\"1682\">\n<p data-start=\"1585\" data-end=\"1682\">Several key dates are relevant, in particular <strong data-start=\"1633\" data-end=\"1647\">01.04.1953<\/strong>, <strong data-start=\"1649\" data-end=\"1663\">01.01.1975<\/strong>, <strong data-start=\"1665\" data-end=\"1679\">01.07.1993<\/strong>.<\/p>\n<\/li>\n<li data-start=\"1683\" data-end=\"1796\">\n<p data-start=\"1685\" data-end=\"1796\">The declaration must be submitted no later than <strong data-start=\"1715\" data-end=\"1733\">until 19.08.2031<\/strong> effectively received (the decisive factor is the <strong data-start=\"1781\" data-end=\"1792\">Entrance<\/strong>).<\/p>\n<\/li>\n<li data-start=\"1797\" data-end=\"1913\">\n<p data-start=\"1799\" data-end=\"1913\">For persons with their habitual residence abroad, the <strong data-start=\"1870\" data-end=\"1900\">Federal Office of Administration (BVA)<\/strong> responsible.<\/p>\n<\/li>\n<li data-start=\"1914\" data-end=\"2055\">\n<p data-start=\"1916\" data-end=\"2055\">You acquire citizenship <strong data-start=\"1953\" data-end=\"1982\">upon receipt of the declaration<\/strong> with the competent authority (not only when the certificate is issued).<\/p>\n<\/li>\n<li data-start=\"2056\" data-end=\"2196\">\n<p data-start=\"2058\" data-end=\"2196\">There are <strong data-start=\"2066\" data-end=\"2086\">Reasons for exclusion<\/strong>, including serious criminal offences, extremist activities and certain cases of subsequent acquisition\/loss.<\/p>\n<\/li>\n<li data-start=\"2197\" data-end=\"2295\">\n<p data-start=\"2199\" data-end=\"2295\">\u00a7 5 StAG is <strong data-start=\"2212\" data-end=\"2247\">No naturalisation \u201eas usual\u201c<\/strong>, but a special way of making amends.<\/p>\n<\/li>\n<li data-start=\"2296\" data-end=\"2462\">\n<p data-start=\"2298\" data-end=\"2462\">Multiple nationality is generally not permitted in the case of <strong data-start=\"2354\" data-end=\"2366\">permissible<\/strong>; Whether your other nationality is affected is decided by the law of your home country.<\/p>\n<\/li>\n<li data-start=\"2463\" data-end=\"2637\">\n<p data-start=\"2465\" data-end=\"2637\">Since <strong data-start=\"2470\" data-end=\"2484\">27.06.2024<\/strong> In principle, multiple nationality is also accepted for regular naturalisation in Germany; naturalisation as an entitlement generally requires at least <strong data-start=\"2775\" data-end=\"2789\">five years<\/strong> ahead.<\/p>\n<\/li>\n<\/ul>\n<h2 data-start=\"2804\" data-end=\"2856\"><span class=\"ez-toc-section\" id=\"1_Was_bedeutet_%E2%80%9EErklarungserwerb%E2%80%9C_nach_%C2%A7%E2%80%AF5_StAG\"><\/span>1) What does \u201eacquisition of declaration\u201c according to \u00a7 5 StAG mean?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"2858\" data-end=\"3281\">The acquisition of citizenship by declaration in accordance with Section 5 StAG is a special legal approach that corrects a previous legal situation that is now regarded as unequal and discriminatory. For decades, nationality law treated certain family constellations differently - in particular depending on whether the <strong data-start=\"3167\" data-end=\"3216\">German parent is the mother or the father<\/strong> was and whether the child <strong data-start=\"3237\" data-end=\"3266\">marital or non-marital<\/strong> was born.<\/p>\n<p data-start=\"3283\" data-end=\"3594\">\u00a7 Section 5 StAG is intended to give these affected persons (and their descendants) the opportunity, <strong data-start=\"3362\" data-end=\"3390\">without integration test<\/strong> and <strong data-start=\"3395\" data-end=\"3427\">without residence in Germany<\/strong> acquire German citizenship - simply by making a declaration to the competent authority if the legal requirements are met.<\/p>\n<p data-start=\"3596\" data-end=\"3747\">Important: The acquisition of a declaration is not an \u201eautomatic\u201c cure. It is a <strong data-start=\"3683\" data-end=\"3704\">Active procedure<\/strong>, which requires proper documentation.<\/p>\n<h2 data-start=\"3754\" data-end=\"3830\"><span class=\"ez-toc-section\" id=\"2_Fur_wen_ist_%C2%A7%E2%80%AF5_StAG_besonders_relevant_%E2%80%93_und_warum_gerade_im_Ausland\"><\/span>2) For whom is \u00a7 5 StAG particularly relevant - and why abroad?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"3832\" data-end=\"4086\">\u00a7 In practice, Section 5 StAG very often affects families who have been living abroad for decades - for example in the <strong data-start=\"3938\" data-end=\"3945\">USA<\/strong> or <strong data-start=\"3951\" data-end=\"3961\">Israel<\/strong> - and where German ancestors are present, but an acquisition by birth was legally excluded in the past.<\/p>\n<p data-start=\"4088\" data-end=\"4122\">Typical starting positions abroad:<\/p>\n<ul data-start=\"4124\" data-end=\"4480\">\n<li data-start=\"4124\" data-end=\"4197\">\n<p data-start=\"4126\" data-end=\"4197\">Emigration after 1945, marriages with foreign spouses<\/p>\n<\/li>\n<li data-start=\"4198\" data-end=\"4271\">\n<p data-start=\"4200\" data-end=\"4271\">illegitimate births with a German father (before the cut-off date of 1 July 1993)<\/p>\n<\/li>\n<li data-start=\"4272\" data-end=\"4371\">\n<p data-start=\"4274\" data-end=\"4371\">Families with a German mother and foreign father with children born before 1975<\/p>\n<\/li>\n<li data-start=\"4372\" data-end=\"4480\">\n<p data-start=\"4374\" data-end=\"4480\">Unclear or incomplete documents, name changes (USA), different document and register systems<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"4482\" data-end=\"4635\">Precisely because documents are often missing abroad or legal issues are passed down \u201ethrough generations\u201c, Section 5 of the German Citizenship Act is often the decisive key.<\/p>\n<h2 data-start=\"4642\" data-end=\"4708\"><span class=\"ez-toc-section\" id=\"3_Die_vier_Fallgruppen_des_%C2%A7%E2%80%AF5_StAG_%E2%80%93_verstandlich_und_prufbar\"><\/span>3) The four case groups of \u00a7 5 StAG - understandable and verifiable<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"4710\" data-end=\"4820\">Essentially, Section 5 StAG asks: <strong data-start=\"4734\" data-end=\"4820\">Do you belong to a legally favoured group and can you prove this?<\/strong><\/p>\n<h3 data-start=\"4822\" data-end=\"4904\"><span class=\"ez-toc-section\" id=\"Fallgruppe_1_Kind_eines_deutschen_Elternteils_%E2%80%93_aber_kein_Erwerb_durch_Geburt\"><\/span>Case group 1: Child of a German parent - but no acquisition by birth<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"4906\" data-end=\"5074\">You are a beneficiary if you are the child of a German parent, but German citizenship was not recognised under the law of the time. <strong data-start=\"5034\" data-end=\"5043\">not<\/strong> could acquire by birth.<\/p>\n<p data-start=\"5076\" data-end=\"5103\">Practically especially often:<\/p>\n<ul data-start=\"5105\" data-end=\"5265\">\n<li data-start=\"5105\" data-end=\"5182\">\n<p data-start=\"5107\" data-end=\"5182\"><strong data-start=\"5107\" data-end=\"5141\">Marital birth before 01.01.1975<\/strong>German mother + foreign father<\/p>\n<\/li>\n<li data-start=\"5183\" data-end=\"5265\">\n<p data-start=\"5185\" data-end=\"5265\"><strong data-start=\"5185\" data-end=\"5224\">Non-marital birth before 01.07.1993<\/strong>German father + foreign mother<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"5267\" data-end=\"5487\"><strong data-start=\"5267\" data-end=\"5280\">Mnemonic:<\/strong> In the past, the mother could not \u201ebequeath\u201c in certain constellations, and the father could often not \u201ebequeath\u201c in the case of illegitimate births. \u00a7 Section 5 StAG now compensates for this.<\/p>\n<h3 data-start=\"5494\" data-end=\"5603\"><span class=\"ez-toc-section\" id=\"Fallgruppe_2_Mutter_verlor_vor_der_Geburt_durch_Heirat_die_deutsche_Staatsangehorigkeit_bis_01041953\"><\/span>Case group 2: Mother lost German citizenship before birth through marriage (until 1 April 1953)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"5605\" data-end=\"5851\">You are a beneficiary if your mother has lost her German citizenship. <strong data-start=\"5677\" data-end=\"5697\">before your birth<\/strong> solely through marriage to a foreigner - during the period in which this result was provided for by law (cut-off date <strong data-start=\"5835\" data-end=\"5849\">01.04.1953<\/strong>).<\/p>\n<p data-start=\"5853\" data-end=\"6022\">This typically concerns the generation of the early 1950s: marriage abroad, loss of citizenship by law, later birth of the child abroad.<\/p>\n<h3 data-start=\"6029\" data-end=\"6090\"><span class=\"ez-toc-section\" id=\"Fallgruppe_3_Verlust_durch_Legitimation_bis_01041953\"><\/span>Case group 3: Loss through legitimisation (until 01.04.1953)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"6092\" data-end=\"6401\">This case group is rare but important: it concerns people who <strong data-start=\"6162\" data-end=\"6184\">German at birth<\/strong> but lost their German citizenship because the German mother married the foreign father after the birth and thus became legally legitimised (according to the legal situation at the time).<\/p>\n<p data-start=\"6403\" data-end=\"6689\">Important in practice: Not every case of a subsequent marriage of the parents automatically leads to a loss. The exact legal assessment depends on historical norms and the specific effectiveness of the legitimisation. These cases should be reconstructed very carefully.<\/p>\n<h3 data-start=\"6696\" data-end=\"6770\"><span class=\"ez-toc-section\" id=\"Fallgruppe_4_Abkommlinge_Kinder_Enkel_Urenkel_der_Fallgruppen_1%E2%80%933\"><\/span>Case group 4: Descendants (children, grandchildren, great-grandchildren) of case groups 1-3<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"6772\" data-end=\"6877\">You are also a beneficiary if you are a descendant of a person who falls under case groups 1 to 3.<\/p>\n<p data-start=\"6879\" data-end=\"7154\">One major advantage is that the ancestor does not have to have made the declaration themselves. Even if the parent or grandparent concerned is already deceased, the descendant may be entitled - the line of descent and the allocation to the case groups are decisive.<\/p>\n<h2 data-start=\"7161\" data-end=\"7214\"><span class=\"ez-toc-section\" id=\"4_Die_wichtigsten_Stichtage_%E2%80%93_als_klare_Merkliste\"><\/span>4) The most important key dates - as a clear watch list<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"7216\" data-end=\"7270\">This data is essential for a quick preliminary check:<\/p>\n<ul data-start=\"7272\" data-end=\"7786\">\n<li data-start=\"7272\" data-end=\"7367\">\n<p data-start=\"7274\" data-end=\"7367\"><strong data-start=\"7274\" data-end=\"7288\">23.05.1949<\/strong>: Only those who <strong data-start=\"7298\" data-end=\"7306\">to<\/strong> born on this date is generally eligible.<\/p>\n<\/li>\n<li data-start=\"7368\" data-end=\"7459\">\n<p data-start=\"7370\" data-end=\"7459\"><strong data-start=\"7370\" data-end=\"7384\">01.04.1953<\/strong>Key date for case groups 2 and 3 (loss of marriage\/legitimisation).<\/p>\n<\/li>\n<li data-start=\"7460\" data-end=\"7548\">\n<p data-start=\"7462\" data-end=\"7548\"><strong data-start=\"7462\" data-end=\"7476\">01.01.1975<\/strong>Key date for acquiring the birth certificate via the mother in the case of marital birth.<\/p>\n<\/li>\n<li data-start=\"7549\" data-end=\"7641\">\n<p data-start=\"7551\" data-end=\"7641\"><strong data-start=\"7551\" data-end=\"7565\">01.07.1993<\/strong>Key date for acquiring the birth certificate via the father in the case of a non-marital birth.<\/p>\n<\/li>\n<li data-start=\"7642\" data-end=\"7705\">\n<p data-start=\"7644\" data-end=\"7705\"><strong data-start=\"7644\" data-end=\"7658\">20.08.2021<\/strong>Start of the ten-year declaration period.<\/p>\n<\/li>\n<li data-start=\"7706\" data-end=\"7786\">\n<p data-start=\"7708\" data-end=\"7786\"><strong data-start=\"7708\" data-end=\"7722\">19.08.2031<\/strong>Latest deadline - declarations received after this date are invalid.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"7788\" data-end=\"7979\"><strong data-start=\"7788\" data-end=\"7807\">Practical note:<\/strong> The decisive factor for the deadline is not when you start or when you sign at the consulate, but when the declaration is effectively received by the competent authority.<\/p>\n<h2 data-start=\"7986\" data-end=\"8034\"><span class=\"ez-toc-section\" id=\"5_Ausschlussgrunde_Wann_scheitert_%C2%A7%E2%80%AF5_StAG\"><\/span>5) Reasons for exclusion: When does \u00a7 5 StAG fail?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"8036\" data-end=\"8178\">Even if \u00a7 5 StAG opens up a clear legal entitlement, the acquisition is not limitless. Typical areas of exclusion or problems are<\/p>\n<h3 data-start=\"8180\" data-end=\"8225\"><span class=\"ez-toc-section\" id=\"1_Schwere_Straftaten_Sicherheitsgrunde\"><\/span>1) Serious offences \/ security reasons<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"8226\" data-end=\"8432\">Anyone who has been sentenced to significant custodial or juvenile sentences or for whom there are special reasons for exclusion under security law may be excluded. An official examination is carried out in this case.<\/p>\n<h3 data-start=\"8434\" data-end=\"8521\"><span class=\"ez-toc-section\" id=\"2_Zwischenzeitlicher_Erwerb_und_spaterer_Verlust_der_deutschen_Staatsangehorigkeit\"><\/span>2) Interim acquisition and subsequent loss of German citizenship<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"8522\" data-end=\"8903\">\u00a7 Section 5 StAG is intended to correct historical discrimination, but not to \u201eundo\u201c later, independent decisions to lose citizenship. Anyone who has subsequently acquired German citizenship by other means and then lost it again may be excluded under the statutory provisions - in some cases also with effects on descendants, depending on the time of birth.<\/p>\n<h3 data-start=\"8905\" data-end=\"8966\"><span class=\"ez-toc-section\" id=\"3_%E2%80%9EGenerationenschnitt%E2%80%9C_bei_im_Ausland_geborenen_Kindern\"><\/span>3) \u201eGeneration cut\u201c for children born abroad<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"8967\" data-end=\"9252\">In the case of certain generations born abroad, there may be constellations in which Section 5 StAG cannot be used to \u201ereplace\u201c missed deadline notifications. These cases are rare, but should be carefully examined in family chains with births after 2000.<\/p>\n<h2 data-start=\"9259\" data-end=\"9338\"><span class=\"ez-toc-section\" id=\"6_Zustandigkeit_und_Ablauf_fur_Mandanten_im_Ausland_USA_Israel_weltweit\"><\/span>6) Jurisdiction and procedure for clients abroad (USA, Israel, worldwide)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"9340\" data-end=\"9454\">People who live abroad usually ask themselves this question first: <strong data-start=\"9399\" data-end=\"9454\">Where do I submit the declaration - and who decides?<\/strong><\/p>\n<h3 data-start=\"9456\" data-end=\"9473\"><span class=\"ez-toc-section\" id=\"Zustandigkeit\"><\/span>Responsibility<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"9474\" data-end=\"9713\">In the case of habitual residence abroad, the <strong data-start=\"9532\" data-end=\"9562\">Federal Office of Administration (BVA)<\/strong> responsible. Many cases do not fail because of the law, but because of missing documents.
