Cyber law: About the legal requirements (e. g. Imprint) your German website must adhere to.

Almost all German websites have to provide a proper imprint (“Impressum”) on their website/homepage.

If websites are based in Germany the website has to provide a proper imprint according to section 5 of the Telemediengesetz (German Telemedia Act).

If the owner of the website violates the obligation to provide an imprint on his website he might get fined up to EUR 50.000.

The reason for the obligation to provide an imprint on the website is the protection of the consumers, but the obligation is also in the interest of business enterprises which are thus able to obtain information about their competitors, e.g. in order to enforce fair competitive practices.

Pursuant to s 5 of the Telemediengesetz service providers offering telemedia on a commercial basis generally offered for profit are obliged to provide certain information in a way that is “easily identifiable, directly accessible and constantly available”.

The imprint of a website of a foreign company providing goods and services to German customers for example should at least provide the following information:

  • Full name and address of the Company.
  • Names of the managing directors of the company.
  • Telephone number, fax number and email address of the company.
  • Name and address of the companies´ court of registration and its registration number.
  • VAT identification number of the company.
  • If the owner of the website offers services within the framework of an activity which requires the approval of any public authorities, details of the responsible supervisory authority have to be provided.

Please note that the company could be obliged to provide much more information in its imprint. This depends on the legal structure of the company and other factors.

    I think something is not good explained. If somebody offers such informations on this website, he should mention whether an imprint obligation exists for commercial websites in USA, too. The question for me is, is somebody who is having an affiliate website obliged to have an imprint on his website like in Germany? I think informations should be given.

    What about naming? Is it sufficient to put this on the „contact“ or „legal“ or „about us“ page or is there a legal requirement for this to be on a dedicated page with specific naming convention?

    I am a Uk e commerce company, selling goods in UK and have replicated and translated my website into German. I export goods into Germany via sales from the website. All sales are taken on the German site and passed through to the UK office for processing.
    Do I simply have to provide the information you stated to meet Impressum requirements on ,my translated website and is it OK for VAT and company information to be from my UK company or do i have to register my company in Germany?
