Traffic law: Behaviour after an accident (at fault or not at fault)

Immediately after an accident (whether it was your fault or not), you as the person involved in the accident should collect evidence as carefully as possible. This includes collecting personal details of witnesses to the accident, taking photos of the accident scene and calling the police.

The person involved in the accident must initially only provide their personal details to the police. Questions about possible physical damage or injuries in particular should not be answered in concrete terms at first so as not to jeopardise potential claims for damages or compensation for pain and suffering.

Even if you are not responsible for the accident, you should contact a lawyer directly, as the costs of the lawyer must always be covered by the other party's insurance.

As the party involved in the accident, you are free to choose both the appraiser and the workshop and do not have to be referred to "independent" appraisers by the opposing insurance company. For damages of EUR 600.00 or more, the expert's costs must also be paid by the other party's insurance company.

As long as your car is in the workshop, you can always hire a car and claim the costs incurred from the other party's insurance company. If you are unable to obtain a replacement car, you may be entitled to compensation for use.

Compensation may be demanded for the following additional costs:

Towing costs

Expert opinion or cost estimate

Expert costs

Repair costs

Legal fees

Impairment

(New) registration costs

Replacement value less residual value (if a replacement vehicle is purchased)

Car hire costs or loss of use

Costs for damaged items

Loss of earnings

lost profit

Medical treatment costs

Medication/Massages

Compensation for pain and suffering (e.g. for whiplash injuries)

Domestic help
